5-4 is a podcast about how much the Supreme Court sucks. It's a progressive and occasionally profane take on the ideological battles at the heart of the Court's most important landmark cases; an irreverent tour of all the ways in which the law is shaped by politics.

The Shadow Docket with Steve Vladeck
As the Court has moved right, it's been using the "shadow docket" to execute on more of its agenda. Previously reserved for emergencies, like stays of executions, the process of hearing cases outside of the Court's ordinary calendar is now frequently used to issue unsigned and unexplained decisions that overturn the status quo. We'll dig into it with University of Texas School of Law professor Steve Vladeck, and author of The Shadow Docket: How the Supreme Court Uses Stealth Rulings to Amass Power and Undermine the Republic.

Palmer v. Thompson
Jackson, Mississippi out here with the supervillian-level attitude towards public goods - "if I have to share, then no one can have it."

The Thomas/Crow Affair [TEASER]
Just to refresh your memory - bribery is when you write "bribe in exchange for your vote" on the memo line of a check, OR when you sign a contract saying you are doing bribes and then drop a pillowcase full of cash off at someone's office while multiple DOJ officials are watching.
A billionaire ferrying a public official around on his private jet and super yacht, while he sits on the board of multiple organizations that are trying to influence the Court, is NOT bribery. It's just friends bein' friends!

So much potential
I want to 5/5 this podcast but it's hard for the hosts to separate their personal opinions from factual information of the cases. Once the legal talk starts, it's great and very insightful. But the heavy bias and clear partisan positions from which the cases are discussed, it's hard to listen to at times. It's still a 4/5 given the legal content, 3/5 still seems too low.
Thoughtful and informative
This podcast is helmed by three articulate legal experts who present Supreme Court decisions in a manner that explores how many decisions by the court have resulted in the loss of rights for many. Their approach is humanitarian which something that seems to be lost in many discussions of law.
The best
Hands down one of the best, funniest, darkest podcasts out there.
