    Ep. 110 - The Home Sale Contingency / Buying A New House When You Need to Sell Your Current One

    Buying a new house when you need to sell your current one can be difficult.  Do you sell yours first and show while you are living there?  If you wait too long, panic can set in trying to find the new home.   But can you afford the deposit and to close on the new home, if your current home has not sold? 
    A home sale contingency clause can be included in your offer to purchase that new home. With a home sale contingency, the transaction is contingent on the sale of the buyer’s home. If the house sells by the specified date, the contract moves forward. But if it doesn’t, the contract can be terminated.  Sounds great right?  But will the Seller accept such a provision?  In a Seller’s market, probably not.  
     
    Why would a Seller give a Buyer the time and the opportunity to cancel the contract if the house they are selling to buy this house falls through?
     
    In this episode, Matthew discusses under what circumstances he, as a Seller, would take such an offer.  Because in the real world, this is a real issue that real people have to deal with.  
     
    Then we discuss the sticky situation Staci found herself in which may result in a new listing.

    Ep. 109 - The Sky is Falling! NAR Settlement Eliminates Real Estate Commissions

    No, the sky is not falling.  On March 15, 2024 the National Association of Realtors (“NAR") settled a $5 Billion Buyer Broker Commission lawsuits brought by class action attorneys for $418 Million Dollars.
     
    In this Episode we break it down. First we discuss how commissions work currently and who pays the commission.
     
    Then we discuss the new rules.  First that Buyer’s will negotiate commissions directly with their agents.  Agents can not claim there is no cost to Buyers, unless they truly will not charge them.  Seller’s can still pay the Buyer’s Agent.  Buyer’s Agents will be required to sign agreements with Buyers setting forth what they will charge.  It will need to be an amount can not be open ended (like whatever the seller offers).  And the Multiple Listing Service can no longer display an offer of compensation to the Buyer’s Agent.
     
    We talk about how these rules will work in the future, both in the short and long term.
     
    And clarify that this lawsuit and settlement does not change anything about renters, the lawsuit had nothing to do with renters, but some or most of these practices will be put in place for tenants regardless.
     
    Why did the NAR agree to this Settlement?  Did they “sell us out” or did they have a VERY good reason?  Tune in and find out!!!!

    "Make sure you pay your taxes; otherwise you can get in a lot of trouble.” I did not write that title.  It is a quote from President Richard Nixon.  The other quote I was thinking of using for a title was by Albert Einstein "The Hardest Thing in the World to Understand is Income Tax.”  That one is amusing because of course, Albert Einstein was a genius and if he thought it was hard to understand, what hope do the rest of us have?
     
    Well there is hope.  And her name is Jessica Green!  Jessica is the managing director of Green Tax and Business Advisors.  
     
    Jessica has a Master in Business with focus in Accounting and has over 15 years of experience in business strategy and has been doing tax preparation, tax strategy, and accounting for over eight years. She enjoys solving complex tax problems and designing strategies to take the tax burden off her clients’ shoulders and believes all clients should be served with the highest levels of accuracy, professionalism, and customer service. 
     
    We discuss many common issues that affect Real Estate Agents and Investors.  Imagine if you will:  You are a real estate agent.  You sell a house and make a $15,000 commission.  There is no withholding, and that money is going to burn a hole in your pocket.  Jessica can help you take the proper deductions and reduce your tax liability, and just as important she can help you plan for the eventual tax bill you will have to pay.
