    Under California state law, the family residence or any real property owned during the marriage is usually considered to be community property (or that there is a community property interest).     Alternatives to Equal Division of Community Property

    Often times the most complicated part of a divorce, aside from child custody, can be the division of assets or property. Unless there is a specific agreement by both parties, the court will divide the assets equally, or 50/50, between both parties, based on the financial valuations of the property (either agreed upon or as determined by a professional evaluator).
