    With the implementation of the Phase One deal between the United States and China on import tariffs, as well as the ongoing global pandemic, the new Silk Roads, and even current supply chain issues, businesses in Asia have been navigating unprecedented circumstances when it comes to product development, marketing, distribution, and sales. 
    But Asia also continues to inspire global leaders to step outside of their comfort zone and use innovation in new ways to expand their business portfolios. While there are over 400 unicorn startups worldwide, over 140 of them are headquartered in the Asia-Pacific region. Asia has also continued to outpace other regions in filing patents, trademarks, and industrial designs, and registering domains, and it has become a top hub for high-value innovation. 
    But what are the most recent market trends in this region from an intellectual property (IP) perspective? And how does innovation translate in terms of trademark registration and enforcement? What are the hot IP issues that are on the radar of IP law practitioners in this region these days? 
    Our guest is Andy Leck, managing principal at Baker McKenzie Wong & Leow head of the Intellectual Property and Technology Practice Group and a member of the Dispute Resolution Practice Group in Singapore. He is a core member of Baker McKenzie's regional IP practice and also leads the Myanmar IP Practice Group. He has more than 30 years of experience handling contentious and non-contentious matters in the areas of IP, corporate litigation, and arbitration matters, and regularly represents Fortune 500 corporations in different fields.     With the spread of the COVID-19 pandemic, countries worldwide have been implementing more or less stringent social distancing and lockdown measures, and the operations of intellectual property (IP) offices have been impacted just as any other businesses or institutions. Many IP offices around the world have implemented emergency policies to limit their services, and some even have shut down for the foreseeable feature. For companies and individuals with worldwide trademark or patent portfolios, now is a critical time to be aware of any changes that may impact their IP management strategies – for the best or the worst.
    Our guest today is Michael Schwager, the Director General of IP Australia, based in Canberra. IP Australia is the country’s IP office responsible for administering IP rights, including trademarks, patents, designs, and plant breeder's rights applications. It was ranked in April 2020 in the Top 10 most innovative IP offices in the world, based on World Trademark Review’s analysis of 50 IP offices.
    Before leading IP Australia as of September 2018, Mr. Schwager spent almost 13 years with the Department of Industry, Innovation and Science of the Australian Government, where he was in charge of what we would call today innovation policy—that is, developing and implementing strategies to foster an internationally competitive, innovative, and sustainable business environment in Australia.

    Business-wise in a complex challenged global economy Africa is more on the move than ever. The World Economic Forum pointed out last year that six of the ten fastest-growing economies in the world are in Africa and the continent’s average annual GDP growth is projected to remain at a robust average of six percent until 2023. 
    How does this unstoppable growth translate from an intellectual property (IP) perspective? What are the continent’s strengths and challenges that can explain where Africa sits right now in the IP world, both legally and from a market perspective?
     Brenda Kahari, the guest of this episode of Brand&New, is not a first-timer. As a reminder, she is the founder of the law firm B.W. Kahari based in Harare, Zimbabwe. Since its beginning, the law firm has focused its practice on IP issues. Brenda is also a regular speaker on topics related to IP for major international organizations such as the African Regional Intellectual Property Organization (ARIPO), the International Trademark Association (INTA), and the World Intellectual Property Organization (WIPO).

    With a steady GDP growth over 5% last year, Kenya is one of the leading economic forces not only in East Africa but on the entire continent. In this context, it’s no surprise that intellectual property issues are at the forefront of most national institutional projects. From legislative amendments to update the main laws in light of new challenges raised by new techs, to punchy enforcement initiatives to tackle counterfeiting, IP issues are regarded as critical to foster the economy. Our guests today, both Members of Kenya Parliament, Honorable David Ochieng (for Ugenya Constituency) and Honorable Alice Muthoni Wahome (for Kandara Constituency), are essential stakeholders of these changes, thanks to their extensive knowledge of legislative, political and judiciary worlds in Kenya. Honorable Wahome is also Chairperson of the Kenya’s IP/Trademark Caucus on INTA and Honorable Ochieng is one of its Members.

    Strengthened by the civil unrest in the United States and across the globe that ignited almost two years ago, companies have been watching and reviewing their brand message but also their corporate cultures and hiring practices to promote diversity, equity, and inclusion (DEI). DEI has become actual priorities for executive teams, HR leaders, boards of directors, marketing teams, and legal departments seeking to ensure their ongoing success by aligning their daily practice with the DEI messages voiced by many in the streets. 
    What does it mean, and what does it take, for a brand to embrace DEI in its customers’ eyes? How can that be challenging for brands whose identity has been built on years and years of tradition; can brands keep their identity and customer loyalty while still, at the same time, evolving in sync with society? What about brands whose targeted markets are all over the globe and therefore do not share the same cultures, including when it comes to the meaning of DEI? And, last but not least, what about the employer brand: How can it implement DEI within an organization in an effective, business-friendly, and performance-oriented way?
    Our guest, Adraea Brown, is assistant general counsel at H-D U.S.A., LLC, based in Milwaukee, Wisconsin, USA, responsible for leading Harley-Davidson’s in-house trademark team, which includes oversight of a portfolio of over 5,000 global trademarks, trademark enforcement, and litigation. She also serves as legal support for the company’s multimillion-dollar licensing and general merchandise business. Ms. Brown has been an International Trademark Association (INTA) member since 2015, and was the co-chair of INTA’s Global Brand Transactions & Due Diligence Subcommittee of the Commercialization of Brands Committee (2020-2021).

    The 2020 Global Gender Gap Report, published by the World Economic Forum, shows that gender parity will not be attained for 99.5 years.  In the intellectual property (IP) industry, even though genders are similarly creative and innovative, it is not a secret to say that the field is predominantly male-oriented.  Women are, for instance, underrepresented in patenting; one study has even projected that women will not see parity in patenting until 2092!  This issue is addressed by the World Intellectual Property Organization (WIPO), which is committed to promoting gender equality and women’s empowerment, as well as by many other local and international initiatives. 
    Our guest today will help us to understand women’s positions when it comes to IP both as an industry and as a practice. Ayala Deutsch is the Executive Vice President and Deputy General Counsel at NBA Properties Inc., based in NYC. The National Basketball Association is widely considered the premier professional basketball league in the world, composed of 30 teams, and is one of the four major professional sports leagues in the United States and Canada. She joined the NBA in 1998 and currently is responsible for managing commercial legal affairs and IP matters for the NBA and its affiliated leagues, including the global acquisition, protection and enforcement of IP rights belonging to the NBA, the Women’s National Basketball Association (WNBA), the NBA G League, the NBA 2K League, and USA Basketball.  
    Ms. Deutsch is also the INTA 2020 President, and will tell us more about her priorities during her tenure as president. In line with Ms. Deutsch’s priorities for her term as INTA’s 2020 President, the Association is proud to launch The Women’s LeadershIP Initiative, a subject held close to her heart. The Initiative—rolled out on International Women’s Day, March 8, 2020—is designed to foster the development of strong leadership skills for women in the IP field, acknowledging the contribution of all-star female professionals to the IP industry while also empowering women to advance their IP careers to the next level. As part of INTA’s strategic direction and focus, the Women’s LeadershIP Initiative will look at where and how the Association may further support and add value to its members in the long run. It will involve the organization of workshops promoting the exchange of views and experiences among women on issues like gender and opportunities, and career development or work-life balance, as well as the development of targeted content to champion women’s talent and professional growth.
