4. Regulating Social Media as a Threat to Humanity

Concerns over the harmful impact of social media are rising to a fever pitch. In the past decade, everyone from conspiracy theorists to foreign governments have used social media to spread election disinformation, sow discord, and peddle viral conspiracies. This month, the Biden administration and the U.S. Surgeon General accused social media platforms of being the primary source of misinformation about Covid-19 vaccines. Likewise, a July 6 paper warned that the invention of social media could cause human society to fail “catastrophically, unexpectedly, and without warning” if it continues down its current path. In the fourth and final episode in our UnChecked series, we are looking at some of the public-policy solutions being proposed to rein in the threats posed by Big Tech and social media. You Can Create Award-Winning Art With AI. But Can You Copyright It?

The art world was rattled when Jason M. Allen won first place in the Colorado State Fair for "Théatre D’opéra Spatial" — digital artwork created with artificial intelligence. Allen had revised his text prompts hundreds of times before landing on the final work; Allen considers Space Opera Theater his creation. But some artists hated his victory. "They were saying I was falsely attributing authorship to something I did not create," Allen said. After winning, he submitted the image to the US Copyright Office for a state-issued seal of approval, an official document certifying that the artwork was indeed his creation. Would the Copyright Office agree? We delved into the controversy surrounding the use of copyrighted material in training AI systems in our first two episodes of this season. Now we shift our focus to the output. Who owns artwork created using artificial intelligence? Should our legal system redefine what constitutes authorship? Has SEC Tips Program Stopped Next Madoff? No One Knows

In the wake of the Bernie Madoff scandal in the late 2000s, the SEC set up a program to reward whistleblowers who uncover fraud against investors. Since then, the program has paid out more than $1.3 billion. But who's receiving this money? And what information are they providing to the agency? And why is a huge chunk of the money going to whistleblowers represented by attorneys who used to work at the SEC? Bloomberg Law reporter John Holland recently published an investigative report looking at all of these questions. He found that the SEC's whistleblower program is operating with shockingly little oversight from either the courts or Congress. Holland joins this week's episode of our legal news podcast, On The Merits, with two of his sources: whistleblower attorney Reuben Guttman, and University of Kansas law professor Alex Platt, who's conducted research into what's happening here. Neal Katyal on Historic Arguments Set for May (SCOTUS Virus Update)

The Supreme Court continued to adapt to the ongoing coronavirus pandemic, allowing media outlets to live-stream arguments for the first time in its 230-year history. In another first, the court also said it will hear those arguments over the phone. Among the case to be argued is the subpoena fight for President Trump's financial records, which will be argued May 12. Former acting Solicitor General Neal Katyal joins Cases and Controversies' hosts Jordan Rubin and Kimberly Robinson to put the court's moves in perspective. Talking Tax- Episode 62- More Answers to Come on Interest Deduction Limitation

New guidance on a tax law change limiting interest deductibility tells taxpayers that the IRS is making progress in helping businesses deal with the change, but some of the more challenging issues have yet to be broached. Tony Nitti, a tax partner at WithumSmith+Brown PC in Aspen, Colo., joins Talking Tax host Allyson Versprille to discuss the guidance—Notice 2018-28—and what it means for businesses. The amended tax code Section 163(j) limits the business interest deduction to 30 percent of a company’s earnings before interest, taxes, depreciation, and amortization for four years starting in 2018. Beginning in 2022, the deduction will be limited to 30 percent of earnings before interest and taxes. The IRS's notice provides a handful of answers on how the limitation will work. It confirms, for example, that interest payments on debt held by members of a consolidated group—a group of corporations with a shared parent company that is treated as a single entity for tax purposes—would be allocated at the consolidated group level, rather than on a member-by-member basis. Government officials had been hinting at this clarification for the last several months. While the notice is a step in the right direction, the Internal Revenue Service and Treasury Department still have a lot of work ahead, Nitti says.
