President Donald Trump's Executive Order #M-25-13 threw our country into a federal funding crisis in the second week of his presidency. Trump's Executive Order temporarily paused all federal funding and disbursement of all federal assistance. This Executive Order was not legal; it violates our very original law - the United States Constitution Grab a glass of wine and join our legal team as we do a deep dive into the law to discover why Donald Trump's Executive Order violates the Constitution, risking an imbalance of our checks and balances's system through the fundamental separation of powers instituted by our Founding Fathers. Though the process is always messy, the annual budget was, and always is, passed by our legislative branch of government - Congress. It was properly vetted, discussed, bartered, and passed by the legislature and then signed into law by President Biden. That budget specifically and properly allocated federal funds to agencies and people across the United States. Under Article I of the Constitution, Congress possesses the "Power of the Purse," whereby it has full, sole, and primary authority to determine where federal funding is disbursed and how. Through this same Article, Congress has full and sole authority to create the law. Under Article II of the Constitution, the President has the power to enforce the law, and under Article III of the Constitution, the courts have the power to interpret the law. Executive Orders fit into a strange quasi-law-making category, but they cannot stop, overrule or cancel another law properly passed by Congress and ratified by a President - even the prior President of a different political party. Despite the desire (and great idea) to review and reduce federal spending, our legal team argues that President Trump only has the authority to ask Congress to review and reorganize the budget again, to suggest ways and means of slashing the budget, and to seek better and more efficient ways of enforcing the budget and reducing waste.
