ATHENA RISING: THE POWER OF THE FEMALE LAWYER & COLLECTIVE

ATHENA RISING: THE POWER OF THE FEMALE LAWYER & COLLECTIVE

Welcome to Athena Rising, the brainchild of Vanessa Singh Johannes & Marissel Descalzo, two white-collar defense and corporate investigations attorneys in Miami, Florida. There are plenty of blogs and podcasts in today’s world, but little to none address the “real” journeys of women in the law. Here, we hope to create a space where stories of successes, hurdles and growth are authentically, openly and honestly shared, for all to learn from and develop through. These include lessons on how we manage work and life responsibilities and our mental, physical, and emotional health in an ever-demanding world. The need for sharing such stories has never been greater. We are witnessing great changes in the legal profession – indeed, more women than men attend law school than ever before; yet, more women in senior positions are choosing to exit the profession or take on different roles. We have personally found that much of our success (and sanity) has come from leaning on our fellow ladies in the law and hope that other women find a collective through this project. Rising tides lift all boats and, together, our voices and stories can help shape our future. Inspired by Vogue’s 73 Questions, the Athena Rising podcast episodes pose 36 Questions to interviewees. Why 36? Thirty-six (36) is a POWER number, evidenced by the ancient Chinese 36 art of war strategies. It is also the number that led to women’s’ right to vote (that is, 36 states were required to ratify the 19th Amendment). And, let’s face it, we can get through 36 Questions faster than 73!

Episode 7: Eugene Pettis, Trailblazer and Personal Injury Attorney

On this episode, Eugene K. Pettis, the Co-Founder and Senior Partner of Haliczer Pettis & Schwamm, discusses his unprecedented leadership in the legal community. Eugene has the historic and laudable designation as the first African American President of The Florida Bar. In his role at the helm of The Florida Bar, which governs nearly 100,000 attorneys, he provided visionary leadership and brought a passion for giving back to his profession and his community. Eugene spearheaded an assortment of initiatives while President, including the conceptualization of the still active William Reece Smith Leadership Academy, a multi-session training program designed to help a diverse and inclusive group of lawyers become better leaders. For 37 years, Eugene's practice has been dynamic. He has represented an impressive number of individual clients in civil trial matters and has also represented many corporate and public sector clients. He handles a range of complex cases, with a primary focus on representing plaintiffs in the areas of medical malpractice, personal injury and commercial litigation. Eugene is a highly sought-after speaker who has used his engaging and enthusiastic style to motivate thousands. He is also the host of the Can We Talk? 360° podcast. Eugene’s “Can We Talk 360°” interview sessions and “Motivational Moments” solo sessions are podcasts created to “provide a safe space where we can openly, honestly, candidly and authentically discuss different perspectives and viewpoints on an array of topics that impact humanity.” He has two daughters, the oldest a litigation attorney in Orlando and the youngest recently received her doctoral degree in child psychology.

Episode 5: Brian Heberlig (Trial Victor Extraordinaire & Steptoe Partner)

Brian Heberlig is a first-chair white-collar criminal defense lawyer with more than 25 years of jury trial experience in complex, high-profile criminal cases nationwide. Like many "real" trial attorneys, he has lost his fair share of cases. But, he's won more than most - including a recent trial victory against the DOJ on behalf of his client, billionaire Dr. Michael Lynch, CEO and founder of Autonomy Corporation (who was once dubbed "Britain's Bill Gates"). Dr. Lynch, a British technology entrepreneur, was charged with artificially inflated the value of Autonomy prior to its sale to Hewlett-Packard in 2011 for $11.7 billion. The trial commenced in March 2024 and Dr. Lynch was found not guilty of all charges in June 2024. Dr. Lynch testified during the trial, which many believe was pivotal in the outcome. Brian led the Steptoe trial team in representing Dr. Lynch, along with Clifford Chance. Among other things, Brian sits down with Athena Rising to tell us how he (and the greater team) worked to build a strong defense of Dr. Lynch and ultimately achieve victory. Brian also discusses why having a diverse legal team, including women, is crucial in providing stellar representation and results for clients. More about Brian can be found here: https://www.steptoe.com/en/lawyers/brian-heberlig.html Some key timestamps from this episode are: 2:12: overview of the Dr. Lynch case 4:30: how HP's civil accusations led to a criminal complaint 13:00: how to build a strong legal team when there are many cooks in the kitchen 13:48: why Dr. Lynch was a pivotal player in structuring the defense 17:04: what it is like to work "with" the client in building the defense 25:10: how to manage a client's expectations when going into a tough trial 32:40: how to make a wealthy client relatable to a jury 50:10: how to keep a jury's attention span when the trial runs very, very long 52:51: making the decision to "put" the defendant on the stand 1:04:03: strategic choices Brian made during the closing argument 1:11:15: Brian's secret to federal jury trial victories 1:13:35: why Brian has stayed at Steptoe for 28+ years 1:17:04: why Brian became a white-collar criminal defense attorney 1:19:09: how the legal profession has changed for women since Brian entered the game 1:23:00: why clients expect diverse litigation teams to represent them 1:24:08: how Brian managed to "balance" his life during trial 1:26:50: Brian's latest fictional reads - and insights into what he does during downtime 1:28:34: qualities that Brian perceives to be his greatest strengths and weaknesses 1:29:35: what Brian would be doing if he wasn't a lawyer 1:31:03: the best advice Brian has ever received 1:33:13: the legacy Brian hopes to leave

Jon Sale is ONE of two attorneys in the entire State of Florida designated a "eminent practitioner" by Chambers U.S.A., the world’s leading legal data and analytics provider, which highlights the top lawyers and law firms across the USA. Currently, Jon is the co–chair of Nelson Mullins' firm’s White Collar & Government Investigations Practice Group. He recently received worldwide media attention for representing a former public official in the House of Representatives’ impeachment inquiry into President Donald J. Trump, which he discusses in this episode. Jon is highly regarded in the SDFL as a talented and powerful lawyer. He is a member of the SDFL's Federal Judicial Nominating Commission, which interviewed candidates for the federal bench and made recommendations to the Senators. He is also a member of the U.S. Magistrate Merit Selection Panel, which recommends to the District Court finalists for Magistrate Judge positions. In terms of his legal expertise, Jon, a former AUSA, is experienced in representing corporations and individuals in grand jury investigations, internal investigations, and diverse and complex criminal litigation, including large scale document reviews and productions. He has represented clients in almost every substantive area of concentration, including health care fraud, securities fraud, financial institution fraud, Foreign Corrupt Practices Act (FCPA) violations, money laundering, criminal anti–trust violations, tax fraud, mortgage fraud, and various fraudulent investment schemes. Notably, Jon served as an Assistant Special Watergate Prosecutor under Special Prosecutors Archibald Cox and Leon Jaworski. His responsibilities extended to supervising grand jury matters and functioning as trial counsel in resulting litigation. He participated in legal efforts to obtain and review secret White House tapes to determine whether criminal conduct had taken place in the Oval Office and among senior Presidential staff members. He also participated in litigating an issue of first impression in the Fifth Circuit, which tested the power of the judiciary when ruling on a government Motion to Dismiss a criminal proceeding. Jon also served as a Special Assistant to the Attorney General of the United States supervising a grand jury investigation to determine if an ambassadorship was awarded as a quid pro quo for a political contribution. While Jon was First Assistant U.S. Attorney in the Southern District of Florida, he supervised all major criminal and civil cases within that judicial district. In U.S. v. Fedorenko, he was the chief prosecutor in a civil denaturalization proceeding against a World War II guard at the Nazi death camp at Treblinka, Poland. Witnesses, who had escaped from Treblinka during the war, traveled to the United States to identify Fedorenko and testify about his war crimes during the trial. The case was ultimately heard by the Supreme Court of the United States, which upheld the decision of the Fifth Circuit and ordered that Fedorenko be denaturalized. Jon has often appeared as a legal analyst on national cable television and radio shows, including Fox News and CNN, and we are privileged and honored to have him here as a guest to discuss how he now lends his stellar career to being an ally!

Episode 2: Matthew Menchel (Badass Trial Attorney and Awesome Human, Kobre & Kim)

We went out on a limb in titling this podcast because Matt is, well, not just a "great" or "wonderful" lawyer or person; rather, he's a badass on all fronts and for many reasons. He's a nationally recognized and highly regarded trial lawyer, but also a true mentor, ally, and all-around good guy. In terms of his professional accolades, they are countless. Matt is widely renowned for his skill in the courtroom and is a Fellow of the American College of Trial Lawyers. Recognized as “an absolutely first-class trial practitioner” by Chambers USA, he is described as “truly gifted at cross-examinations and at communicating with a jury.” The Daily Business Review has twice chosen him as the "Most Effective Lawyer" in the criminal law category. The presiding judge on a highly publicized, eight-week-long Foreign Corrupt Practices Act trial commented about Matt's trial skills: “his cross-examination was about as textbook an example of a vigorous cross-examination as I’ve ever seen.” In a separate, high profile white collar criminal matter in the Southern District of New York, the presiding judge called Matt's summation “among the top 2-3 [summations] I have seen in my 25 years on the bench.” Before joining Kobre & Kim, Matt was a federal prosecutor at the U.S. Department of Justice (as an Assistant U.S. Attorney in the Criminal Division of the U.S. Attorney’s Office for the Southern District of Florida), where he was also Criminal Division Chief for a number of years. He also served as a prosecutor in the Manhattan DA's Office, during which time he trained Assistant District Attorneys in trial advocacy as the director of legal training. This episode is a little over an hour long. We encourage you to listen to all of it, but here are some useful time stamps: 2:58 - why Matt became a defense attorney after 21 years as a prosecutor (and only for the firm Kobre & Kim) 5:20 - the internal struggle in giving up his "identity" and the "calling" of being a prosecutor 12:32 - how Matt learned to become a businessman and "ask for money" on the defense side 12:19 - why Matt the defense lawyer is not much different from Matt the prosecutor 19:20 - how Matt manages being honest to himself and the court, while balancing client needs 23:31 - "It's amazing how many prosecutors think the system is just and right, and then they go to the other side and all of a sudden, 'This system is just unbelievably screwed up' ... and of course, the only thing that's changed is your perspective has widely shifted. The system has not changed; you've changed. And with it, your perspective has changed." 25:57 - why Matt thinks putting a defendant on the stand shifts the burden of proof in a criminal case 33:35 - rolling the dice and not putting on a defense case in United States v. Raoul Weil 38:25 - Matt's biggest learning lesson from the Weil case 45:14 - "the day I am not nervous is the day I f*^)$! quit" 48:31 - why Matt has a dive/scuba slate in his shower 50:45 - "jury selection is a process of deselection" 53:49 - "juries are really not unpredictable ... if you have sat through the trial, they usually get it right" 56:31 - how growing up changes how a trial lawyer relates to a jury 1:01:03 - why sounding like a normal person (not a lawyer) is the best way to relate to a jury (and why Matt gets inspiration from stand-up comedians) 1:02:30 - why mentorship matters to Matt 1:03:52 - what Allies can do to help bridge the wealth/pay gap between men and women 1:05:20 - what steps Allies can take to close the opportunity gap between men and women 1:07:20 - why Matt relies on Adrianna, a female partner in his firm, to run a case and "get" the technical aspects down 1:08:58 - why firms need to take womens' workloads into account 1:13:24 - best personal advice that Matt has ever received 1:14:17 - Matt's most important failure that he is now grateful for 1:17:00 - what Matt hopes his legacy will be
