Employees need Representation! | The Legalist Guest: Adian Miller - Associate Attorney at Barrett & Farahany

Employees need Representation! | The Legalist  Guest: Adian Miller - Associate Attorney at Barrett & Farahany Hi I'm Lee Davis attorney and owner of Lee Davis law LLC here in Atlanta, Georgia and this is The Legalist. If you've seen any of our past episodes you know that most of them are very well produced by my agency, Agency 850 who produces these videos for me. But for the last several months of course we've all been quarantined under the covid19 crisis and therefore this is another rather informal edition of our show. Today and I've got a special guest with me, Adian Miller is another attorney here in the Atlanta area and i'm going to let her tell you about her practice areas and a little bit about herself. Adian. My name is Aidan Miller I'm an employment attorney and practice in Atlanta. I'm at the law firm of Barrett & Farahany. We handle cases on behalf of employees who find themselves victims of discrimination or retaliation or harassment, a hostile work environment in the workplace and so I have been doing that particular area of law for several years now. I've been a labor and employment attorney for about 11-years now and I've been in the Atlanta area for about five and it felt like home the moment I got here. So I don't see myself going anywhere anytime soon. Excellent well I know that you and I have talked about some of the current events that have kind of been going on around us not just with Covid 19 but also with a lot of the social unrest and some of the issues in our society, cultural issues that are really boiling over at times today and I know that that's kind of right in your wheelhouse. So I'm very interested to hear what you have to say about a few topics and I know the people that watch this video are going to be be interested as well.

Helping People and Redemption | The Legalist - Guest Ricardo Gonzalez

Helping People and Redemption | The Legalist - Guest Ricardo Gonzalez Hi, I'm Lee Davis attorney and owner of Lee Davis Law LLC here in Atlanta Georgia and this is the Legalist. So welcome to another episode. As you can see this is another casual version of our video series due to the Covid 19 crisis. But today I have a very special guest and I'll introduce him in just a moment, but before I do that I want to tell you a little bit about why we're doing this episode today. We're filming this during a lot of the unrest over the recent police brutality and the backlash to the black lives matter movement and so today this is a very appropriate topic for this point in time in our country's history. But before we get started with Ricardo, I wanted to relate a short little story that actually kind of shaped the person that I am and the way that I see the world in some ways. It's I guess you could call this one of my four core memories in life that kind of made me who I am. So when I was about 10 years old I lived in a neighborhood in Louisville, Kentucky and it was like most neighborhoods in Louisville, all white and the first black couple moved in with their child who was a couple years younger than me down at the end of our street and for whatever reason I really really liked him we used to play a lot. He was very athletic he was always trying to teach me how to do a front-flip which he could do standing still. which I never got, I landed on my head many many times, but he was always just a great guy and I really really enjoyed him as a friend and one day we were playing in his front yard when this neighbor who was kind of the neighborhood bully came out and for whatever reason was having a bad day.    #LeeDavis #TheLegalist #LeeDavisLaw #RicardoGonzalez

What is the Concept of Society? | The Legalist

What is the Concept of Society? | The Legalist Hey it's Lee Davis attorney and owner of Lee Davis Law and I'm back here with another kind of quick-hitter video just about some basic thoughts that I've been having recently during the Covid 19 crisis and just kind of... it all really dovetails into what our society and what our system of laws is really based on. So there's been a lot of talk about individual liberties and what we should do and what we should be able to do and is the government overreaching and so it just has me kind of thinking about all of these different concepts and really the whole reason that we have a constitution in the first place and that is the concept of society. Now I know we use the word Society all the time but Society really is a concept that's more complicated than the way we typically use it. The concept of society is actually an evolutionary step in human beings and that is there's a point at which people stopped making their day-to-day efforts at bare subsistence and you know it used to be at one time that people lived on a plot of land and they spent all of their time basically providing food for themselves providing water for themselves the bare necessities of life and at some point probably I would say during the Industrial Revolution and the things that followed. Humanity started being able to divide up into different segments and it provided a lot more freedom. So I don't I'm a lawyer I don't have to spend all my time growing my own food or growing or raising animals for food. There are other people in society that do that and because of that society is really like a really big jigsaw puzzle.  I'm just one small piece the farmer is another small piece and doctors are another piece and all of us have the ability to be specialized in the different things that we do because we are all part of a society and at the center of that society is an unwritten societal

Is the state government reopening the economy too early? Is it safe? Can we now sue the Governor? | The Legalist

Is the state government reopening the economy too early? Is it safe? Can we now sue the Governor? | The Legalist  Hey this is Lee Davis attorney and owner of Lee Davis Law in Atlanta Georgia and you may have seen some of my other videos which are very well produced and very professionally done by the folks that I normally hire to do these things but today I've just got a couple of thoughts that I wanted to share with everybody.  They're more topical because of the Covid 19 crisis and so this is going to be a little bit more informal and it's just going to be me kind of sharing my thoughts on some different issues. so yesterday just to put this video kind of in context with where we are during the Covid 19 crisis. This is April the 23rd and on April the 20th  The governor of Georgia, Brian Kemp announced that Georgia was going to start reopening certain businesses after being shut down for a while because of the Covid 19 crisis. So this question or this this question that I'm going to talk about today is directly relevant to the governor's decision to reopen the state. You might know it's a very controversial decision here in Georgia. I think it's getting a lot of national attention because President Trump even weighed in with it and said that he doesn't agree with the decision. He strongly disagrees I think was it was his words and so it's kind of topical and the question that I received from someone was can we sue the governor if his decision ends up turning out badly? And the short answer to that is no. Now I'm not going to just end it there I'm going to explain why it's know basically, we can't sue the governor or  a lot of government officials because of a concept called sovereign immunity. sovereign immunity is a legal concept that has its roots all the way back to England when the king was the be-all and end-all of all laws and application of laws and everything else and sovereign immunity basically in its most basic form is you can't sue the king the king is the    #TheLegalist #BrianKemp #Georgia #Covid19 #LeeDavisLaw

Martial Law during the Covid 19 Outbreak? What is it and what does it mean? | The Legalist

Martial Law during the Covid 19 Outbreak? What is it and what does it mean? | The Legalist Hi I'm Lee Davis attorney and owner of Lee Davis Law LLC here in Atlanta Georgia and this is the legalist. Now typically on the Legalist, I try to explain complex legal concepts in ordinary normal everyday English so that everyone can understand what they might be and today is no exception except that I am also going to be playing amateur videographer that is because I am currently observing social distancing recommendations due to the Covid 19 crisis as are the professionals that normally help me with these things so while this video hopefully will be informative I can assure you it's not going to be the top-notch professional quality that you're normally used to on this show however I hope to offer some very valuable information about something that we might be seeing in the future possibly near future however I hope to provide some valuable information about a legal concept that you might be hearing about in the near future with regard to the Covid 19 crisis and that is martial law. There's two questions I want to answer today. First what is martial law and second do we need to be afraid? I want to answer the second one first. Not necessarily. there are times when martial law is very helpful in keeping order and getting the community back on their feet but then there are other times when it has been abused. So hopefully at the end of this video you will understand that there are times when martial law could be helpful but that we need to be vigilant and make sure that the second to the need is over so is  martial law. First I want to address the question what is martial law? Martial law is simply the replacement of civilian laws and possibly civilian government in favor of military law. In extreme cases the government can be set aside any military governor can be appointed but these are pretty rare certainly in the United States, at least
