    Episode 4 - Remedies in EU Merger Control (Marion Bailly)

    In this new episode of Antitrust Insights, we speak with Marion Bailly from the European Commission’s DG COMP, speaking in a personal capacity, about remedies in EU merger control. We begin with the main typology of merger remedies, including the distinction between structural and behavioural remedies, as well as mechanisms such as upfront buyers, fix-it-first and crown jewel solutions. We then explore the role of behavioural remedies, particularly in Phase I investigations, and discuss how competition agencies should approach remedies aimed at securing merger-specific efficiencies. Finally, we examine some of the most challenging practical issues arising in remedy negotiations and implementation, as well as coordination challenges in multijurisdictional merger investigations.
