Constance Marten and Mark Gordon: The Judge

Constance Marten and Mark Gordon: The Judge

In this episode Caroline and Jack bring you the Judge, Mark Lucraft KC. His job now, at the end of this trial, is to sum up this case, to remind the jury of the evidence they've heard. Today he reminded them what Constance Marten had told them as she spent several days in the witness box. He also referred to the evidence from the two pathologists who had told them Victoria's body was so decomposed they could not conclude how she died.

Constance Marten and Mark Gordon: ‘Are any of these things criminal?’

Constance Marten and Mark Gordon: ‘Are any of these things criminal?’

In this episode, Caroline and Jack bring you the closing speech of Constance Marten's barrister, Francis Fitzgibbon KC, as he urged jurors to acquit her of the killing of her baby, Victoria. He told the Old Bailey 'the evidence isn't there' to convict the aristocrat and her partner Mark Gordon over Victoria's death and accused the prosecution of describing the baby as 'it' which, he said, was 'jarring and dehumanising'. The episode will also feature his suggestion that jurors should ignore the 'nasty bit of class prejudice' used by the prosecution to 'smear' her.

Constance Marten & Mark Gordon: Big Fat Lies

Constance Marten & Mark Gordon: Big Fat Lies

In this episode, Caroline and Jack bring you the closing speech of the Prosecutor Tom Little KC. He told the jury Constance Marten had told “big fat lies” in her defence. Lies, he said, which “fell like confetti from her lips”. And he said despite Mark Gordon “grandstanding” to police about his “rights” he had refused to give evidence when the moment arrived. He said Victoria was caught in the middle of her parents toxic relationship, she was freezing cold, and she never stood a chance.

Piglitsme ,

Reasonable reporting until the verdict.

The first part of the podcast was intereresting, following what happened weekly in the trial, with the exception that every introduction had the clip along the lines that 'some of these people were or are parents' which is somewhat offensive and insensitive to bereaved people who never stop being parents even if their child is dead. This seemed to be removed after several weeks, maybe they realised how offensive it was.
However once the verdict was in it was straight into typical 'nasty Daily Mail journalism', with comments along the lines of "I would have been banging on the table and shouting if they accused me of these crimes." This fails to recognise that just because someone does not behave in a "typical" way it does not mean they are guilty of anything except being different to you.
Also included were comments which suggested Lucy Lettby could not have PTSD (which she has been clinically diagnosed as having), because she was co-operative with police and 'appeared fine'. Clearly implying a diagnosis can be made by those watching, like journalists and police, and not relying on qualified experts like psychiatrists. The worst comment was Lucy should have been forced to walk into court like all other defendants, despite her having been diagnosed with PTSD!
To be honest I turned off then.
Here was a chance to analyse how someone behaved when investigated, to get in psychologists or pschiatrists in to explain what kinds of things lead to these types of crimes, instead of which typical horrendous judgemental comments. Yes she did terrible things but that shouldn't mean we act badly to retaliate.
For sure Lucy Letby is not normal but surely its better to understand what drives people than to demonise. Big THUMBS down from me after the verdict was in this became just a horrible critical podcast.
