5. Did Schoolhouse Rock Lie to Us?

A generation of schoolchildren learned from Schoolhouse Rock that bills become laws through careful committee work, open debate, and thoughtful compromise. But as this episode of UnCommon Law makes clear, that tidy version of lawmaking no longer reflects reality. Instead, leaders often craft omnibus bills in back rooms and create deliberately vague laws that punt hard decisions to federal agencies. But with the Supreme Court's Loper Bright decision ending 40 years of judicial deference to agencies, critics say Congress can no longer hide behind this broken system. In this season finale, we hear from a current and a former US senator on opposite sides of the aisle who both argue that Congress must reclaim its constitutional role. They agree that decades of delegating authority to agencies has weakened the legislature, but they diverge on what should happen next. Should lawmakers strip out vague catchall words to limit agency discretion? Or should Congress work more closely with agencies to ensure workable, expert-informed legislation? But can a deeply polarized institution actually change? While both senators agree on some solutions, they differ sharply on whether a different approach is possible in today's political climate. Ex-Treasury Official Plowgian Talks OECD Deal's Future

Michael Plowgian, who in December left his role as deputy assistant secretary for international affairs at the Treasury Department, had an eventful stint at the department. The former top OECD negotiator for the US started at Treasury in October 2021 as a counselor right around the time over 140 countries agreed to the global tax deal. Since then, Plowgian has been a part of large steps in the deal's progression—from tranches of Pillar Two rules to the release of a draft multilateral treaty text that would reallocate large multinational companies' residual profits to market jurisdictions. The international tax pact consists of two parts: a reallocation of large multinational companies' residual profits, known as Pillar One, and a 15% global minimum tax, known as Pillar Two. The work at the Organization for Economic Cooperation and Development, and therefore the Treasury, isn't done. Plowgian talked to Bloomberg Tax reporter Lauren Vella about what's next for the deal, how the multilateral treaty might fare in Congress, and what red lines the US won't cross in further negotiations with other countries. NCAA at Supreme Court: The Perfect March Madness

A day after the NCAA wraps up basketball's Elite Eight, the Supreme Court team of nine will consider whether collegiate athletes can receive compensation. The justices will hear argument March 31 in an antitrust case where the Ninth Circuit invalidated limits on education-related compensation for college athletes, but preserved the NCAA’s ban on outright pay. That argument, which will conclude the March sitting, will be preceded by two other class action cases. These include efforts to limit securities actions and the damages available to class members. Death Row Defendants Find Few Wins at Supreme Court

Death penalty cases are often adjudicated for years, if not decades, before they reach the Supreme Court.
