Trump Likely to Drop Investigation of Google Gender Discrimination

According to one study, only 31% of Google's employees are women. The Department of Labor has opened an investigation into whether or not the company discriminates against women. Now the Department of Labor is suing Google to get them to release more internal data on diversity. However, Google is not cooperating with the investigation. University of Wyoming Labor Law Professor Mike Duff tells Payday's Mike Elk that it is likely the Trump Administration will slowly kill the investigation. Duff and Elk discuss what type of enforcement actions the Trump Administration is going to allow and why the Google investigation is unlikely to continue. Thurgood Marshall's Strategy of Losing - Alabama NAACP Fight for $15 Lawsuit - #OrganizeTheSouth

This week on #BossTalk, the podcast that shows you how to use the law to fix your boss, University of Wyoming Labor Law Professor Mike Duff and Payday Senior Labor Reporter Mike Elk discuss Elk’s new article in The Guardian “Activists fight North Carolina law barring cities from raising minimum wage.” We get wonky as we talk about how pre-emption laws passed by white state legislators in the South are preventing majority-black cities from increasing the minimum wage at the municipal level. The Alabama NAACP and Greater Birmingham Ministries have a pending lawsuit against the State of Alabama that alleges the majority-white state legislature violated the 1965 Voting Rights Act when it passed a law overturning majority-black Birmingham’s raising of the minimum wage to $10.10 an hour. Professor Duff provides a sober analysis that, though most of these lawsuits likely won’t work, they may instead help build legal campaigns and precedents that will lead lawyers to shop for convenient courts. We discuss how Thurgood Marshall would drive into small towns in the South expecting to have his life threatened and lose civil rights challenges just to build case law. So tune in this week for #BossTalk, where each week we pick a unique case study of how workers are using labor law and organizing tactics to push back against the boss.

Trump Silences OSHA - Alabama Temp Deaths - Frozen Trucker Case

Our first episode focuses the deaths of temp autoworkers in Alabama and how temporary workers are hurting labor in the South. We talk about Bloomberg Businessweek’s expose “Inside Alabama’s Auto Jobs Boom: Cheap Wages, Little Training, Crushed Limbs”. The episode also explores Trump’s attempts to silence OSHA from publicly announcing enforcement action. Former National Labor Relations Board attorney Mike Duff talks about the fear that existed among career employees at the NLRB during the Bush Era. Last week, Supreme Court appointee Neil Gorsuch was grilled last week for writing a legal decision against the case of a truck driver who walked off the job because he was freezing to death. Mike Duff talks about why his decision may have been legally sound and what that says about the weakness of labor law. Finally, Mike Duff gives his “fix” on how to protect yourself legally when speaking up to your boss in a non-union workplace.
