BREAKING: The Trump administration has unveiled a sweeping new proposal that could put the federal tax-exempt status of as many as 18,000 private schools, colleges, universities, professional schools, and trade schools on the line. Under the proposed Treasury Department and IRS regulations, private educational institutions could lose their 501(c)(3) tax-exempt status if they maintain policies or programs that discriminate or provide preferences based on race, color, or national or ethnic origin. The proposal reaches far beyond college admissions. It could apply to scholarships, financial assistance, athletics, educational programs, facilities, and other school-supported activities. The administration says this is about enforcing one uniform standard: racial discrimination does not become acceptable simply because it is called diversity, equity, or inclusion. Schools would still be allowed to help disadvantaged students using race-neutral criteria—including family income, geography, first-generation status, individual hardship, military-family status, and academic achievement. But there is an important distinction: this is currently a proposed regulation, not a completed mass revocation of schools’ tax exemptions. If finalized, it would apply to tax years beginning on or after May 31, 2027.
