What Photographers Get Wrong About Copyright (And How to Protect Your Work)

You created the image. You own the copyright. So what happens when someone uses your photograph without your permission? In this episode of Beyond the Image, James Patrick breaks down one of the most overlooked parts of running a photography business: understanding and protecting your intellectual property. James explores the difference between copyright and trademark, why photographers often wait until something goes wrong to learn about their rights, what questions to ask when your work is used without permission, and why contracts, licensing, documentation, and education matter. He also addresses some of the questions photographers ask all the time: Should you register your copyrights? What should you do when someone uses your image without permission? What happens when a client gives your images to someone else? Can you protect a creative concept or idea? When should you handle an infringement yourself, and when should you talk to an attorney? James is a photographer, entrepreneur, and longtime creative-industry professional, not an attorney, so this episode isn't legal advice. Instead, it's a conversation about knowing what you don't know and being better prepared to protect the work you've worked so hard to create. James also discusses Protect Your Work: Copyright & Trademark for Creatives, a live Q&A taking place August 26 at The Hive Studios in Phoenix with attorney Wendy Neal. Doors: 5:00 PM Program: 5:30 PM Admission: $5 Location: The Hive Studios, Phoenix, AZ Bring your questions. Get real answers. Protect your work.

I Followed Peerspace's Rules. They Flagged My Account Anyway.

What happens when you follow a platform's rules exactly as they're written… and still get flagged? In this episode of Beyond the Image, James Patrick shares his recent experience with Peerspace after a potential renter tried to move a conversation off-platform. James did exactly what Peerspace's rules require: he refused and kept the conversation on the platform. He was then flagged by Peerspace anyway. What followed raised much bigger questions about the relationship between Peerspace and the small businesses that supply its marketplace. James breaks down Peerspace's increasingly aggressive enforcement of its off-platform booking policies, the rise in its host service fee from 15% to 20%, and its introduction of paid promotional placement that allows hosts to spend more to compete for visibility. He also raises a serious concern about renter safety and accountability. What information are hosts actually given about the people entering their businesses? And what happens when a renter causes damage, uses a screen name, or provides little identifying information? There's another consequence that often gets overlooked: when the cost of doing business on a platform increases, those costs don't simply disappear. Small businesses may have to raise their rates, and those increases ultimately get passed on to renters. James also shares the response he received directly from Peerspace's founder after raising these concerns publicly, and why, while he appreciated the response, he believes it addressed only one piece of a much larger problem. This isn't about whether Peerspace should have rules. It should. It's about how those rules are enforced, how hosts are treated, what protection and accountability hosts can expect, and whether a platform taking 20% of every booking is actually treating the businesses supplying its inventory like customers. If you're a Peerspace host, renter, photographer, studio owner, or small-business owner, James wants to hear your experience. Are you seeing the same thing? Why Photographers Feel Invisible (And Why More Leads Won't Fix It)

You create great work. Your clients love the experience. So why does it still feel like no one knows who you are? In this episode of Beyond the Image, James Patrick breaks down one of the biggest misconceptions photographers have about growing their business: believing that more followers, more leads, or another marketing tactic will finally make them visible. The truth is, most photographers don't have a lead problem. They have a positioning problem. You'll learn why talent alone doesn't create opportunities, how to become known for something specific, and what actually builds trust with the clients you want most. James shares practical strategies to help photographers stop hiding behind their portfolio, communicate the value behind their work, and become the obvious choice in their market. In this episode you'll discover: • Why great photography doesn't automatically generate new clients • The difference between visibility and positioning • Why sharing your process is often more valuable than sharing another finished image • How your opinions and personal brand make you memorable • Why more leads won't matter if people don't trust you • The five stages of visibility every photographer should understand • How consistency creates authority and keeps you top of mind If you've ever felt overlooked despite producing incredible work, this episode will help you shift your focus from chasing attention to building a reputation that's impossible to ignore. What to Do When a Client Cancels Your Photography Project

Every creative eventually gets the email or phone call they never want to receive: "We're going to have to cancel the project." Whether you're a photographer, videographer, designer, or creative entrepreneur, canceled projects can cost far more than just the paycheck. They cost planning time, production hours, reserved calendar space, and lost opportunities. In this episode of Beyond the Image, I share several real stories from my own business—including projects canceled just days before production—and explain how I now protect my business with stronger contracts, retainers, cancellation policies, and onboarding systems. You'll learn how to respond professionally, protect your time, and reduce the financial impact when projects inevitably fall through. Because while you can't prevent every cancellation, you can prevent them from becoming expensive lessons. In this episode: Why project cancellations happen—even with great clients The hidden costs of canceled productions How to respond professionally without damaging relationships Why every creative needs a signed contract The difference between a deposit and a retainer Creating cancellation and rescheduling policies that protect your business When it's appropriate to ask a client to compensate you for work already completed Building an onboarding process that minimizes risk before production begins Real-world examples of contracts saving thousands of dollars (and what happens when you skip them) Key Takeaway Your goal isn't to eliminate cancellations. Your goal is to make sure cancellations don't derail your business. Strong systems, clear contracts, and retainers won't prevent every problem—but they'll make sure one canceled project doesn't become an expensive lesson.
