    Lindsay Clancy Trial Day 19 | Mistrial Fight Erupts During Expert Testimony

    Day 19 of the Lindsay Clancy trial brought some of the most contentious expert testimony yet. The morning began with defense attorney Kevin Reddington continuing his cross-examination of Commonwealth forensic psychiatrist Dr. Avram Mack, who maintains that Lindsay suffered from major depression but was not psychotic and remained capable of understanding that killing Cora, Dawson and Callan was wrong. The exchanges became heated enough that Judge William Sullivan repeatedly intervened, including after Reddington challenged Mack over his experience with postpartum mental illness. The Commonwealth then called its second rebuttal expert, forensic psychologist Dr. Kirk Heilbrun. Interestingly, Heilbrun diagnosed Lindsay with Bipolar II disorder, but rejected the defense's explanation that an acute psychotic episode and command hallucination caused the killings. Instead, he offered a theory of suicide combined with altruistic filicide—that Lindsay intended to die and killed the children because she believed they would suffer without her. He also questioned Lindsay's report of suddenly hearing a male voice only during the killings, suggesting the reported hallucination could have been exaggerated or fabricated. Then came a major courtroom confrontation. Heilbrun referenced Lindsay's Catholic faith while discussing suicide. Judge Sullivan immediately stopped the testimony and sent the jury out. Reddington moved for a mistrial, particularly significant because religion had already become an issue earlier in the defense case. Sullivan denied the mistrial but strongly condemned the religious reference and instructed jurors that Lindsay's religion must play no role whatsoever in their deliberations. Day 19 ultimately sharpened the central question facing this jury. The defense experts say Lindsay was psychotic and lacked criminal responsibility. The Commonwealth's experts agree she was seriously mentally ill—but argue that mental illness did not prevent her from understanding or controlling what she was doing. With Heilbrun's testimony still unfinished and the Commonwealth's rebuttal continuing, closing arguments and jury deliberations are now very close.

    Lindsay Clancy Trial Day 18 | Defense Rests as Experts Clash Over Psychosis

    Day 18 brought the Lindsay Clancy defense case to an end with testimony from renowned forensic psychiatrist Dr. Phillip Resnick, who previously testified in the Andrea Yates case. Resnick told jurors he believed Lindsay was “frankly psychotic” when she killed Cora, Dawson and Callan. He described her reported command hallucination and her belief that an outside force had taken control, concluding that she could not appreciate the wrongfulness of her actions or control her behavior. He also testified that he found no evidence Lindsay was malingering or exaggerating her psychiatric symptoms. After Resnick finished, Kevin Reddington announced, “Lindsay Clancy rests,” and the Commonwealth immediately began its rebuttal case with forensic psychiatrist Dr. Avram Mack. Mack offered jurors a dramatically different interpretation, diagnosing Lindsay with major depression and anxiety while disputing the defense's bipolar diagnosis and the claim that she was psychotic. He testified that Lindsay retained the ability to control her actions and revealed a striking detail from his interviews with her: Lindsay recalled telling the children “go to God” while strangling them. Day 18 gave the jury the expert battle this trial has been building toward: Was Lindsay experiencing postpartum psychosis that eliminated her criminal responsibility, or was she severely depressed but still capable of understanding and controlling what she was doing?     Lindsay Clancy Trial Day 17 | Chaplain Reveals What Lindsay Said About the Voice

    Day 17 of the Lindsay Clancy trial was unusually short but produced important new testimony. Hospital chaplain Sheila Cavanaugh, who has visited Lindsay at least 14 times since the deaths, testified that Lindsay repeatedly described hearing a persistent male voice telling her to kill Cora, Dawson and Callan and then kill herself. Cavanaugh also recalled Lindsay expressing relief that her children were now “safe,” testimony the defense can use to support its claim that Lindsay's thinking remained delusional after the killings. Prosecutors challenged the account by pointing out that some of these details were not included in Cavanaugh's contemporaneous notes. Before testimony began, there was another unusual courtroom development: jurors were questioned individually by Judge William Sullivan, following Wednesday's unexplained early adjournment. The substance of those conversations has not been publicly disclosed. Then, after only about 30 minutes of testimony, Sullivan sent the jury home early for the second consecutive day. Closing arguments are now expected early next week as the defense approaches the end of its case. Outside court, hundreds of supporters—many dressed in pink—gathered in a silent demonstration supporting Lindsay and calling attention to postpartum mental illness and gaps in maternal mental-health care.     Lindsay Clancy Trial Day 16 | Expert Says She Was Not Criminally Responsible

    Day 16 of the Lindsay Clancy trial centered on pivotal testimony from forensic psychologist Dr. Paul Zeizel, who told jurors that Lindsay suffered from bipolar disorder with postpartum psychosis and was not criminally responsible when she killed Cora, Dawson and Callan. Zeizel testified that Lindsay could not appreciate the wrongfulness of her actions or conform her behavior to the requirements of the law—directly addressing the legal standard at the heart of her defense. Jurors also heard more about Lindsay's reported delusions, suicidal behavior and the male voice she says commanded her to kill the children and herself. Outside the jury's presence, former McLean Hospital social worker Emily Thorndike was questioned as a potential defense witness, but Judge William Sullivan ultimately ruled that she would not be permitted to testify before the jury because of the limited relevance of her testimony. The day then ended unexpectedly. After lunch, Judge Sullivan dismissed the jury because of an “unforeseen circumstance,” telling jurors the situation was something the court had not anticipated and instructing them not to speculate or hold the interruption against either side. No official explanation for the early adjournment was disclosed.
