    The Legal and Medical Aspects of the PPD (Permanent Partial Disability) Exam

    In today's episode, we'll be discussing the legal and medical aspects of the PPD permanent partial disability exam, which is part of the process in most workers' compensation claims.  And we'll do that with two experts, Jason Mills, partner at GGRM Law Firm, and Dr. James Anthony, GGRM's Chief Medical Officer. Dr. Anthony is an experienced clinician and teacher, and he is one of the most respected Permanent Partial Disability (PPD) rating doctors in the state who has assessed and rated thousands of workers' compensation claims for the past 20 years. He’s been practicing and teaching medicine for more than 36 years. He's also a trained lawyer, obtaining his JD from Florida State, and is a member of the Florida Bar.  Over his career, Jason D. Mills, Esq. partner at GGRM Law Firm, has acted as lead counsel on several thousand contested workers’ compensation claims. He has developed a reputation as a tireless advocate for his injured clients. Mr. Mills has successfully litigated workers’ compensation cases through the Nevada Industrial Insurance system at all levels of the administrative law process, from the initial Hearing Office through the Nevada Supreme Court.  Mr. Mills is also active in the state trial lawyers association, the Nevada Justice Association (NJA). In that capacity, Mr. Mills has both lobbied and testified for the NJA on important issues related to Nevada’s injured workers at the Nevada Legislature since 2015. In 2016 Mr. Mills was elected to the Board of Governors for the NJA. In 2017 Mr. Mills was awarded the NJA’s “Badger Award” for his distinguished service to the association and the people of the State of Nevada. In 2018 Mr. Mills was elected to the Board of Trustees for the Citizens for Justice, the NJA political action committee. In 2018 the State Bar of Nevada selected Mr. Mills as one of the five co-founding board members to serve on the State Bar of Nevada Board of Workers’ Compensation Legal Specialization in order to create and administer a state bar certification and testing process for attorney specialization in the field of Nevada workers’ compensation law. Mr. Mills is also a member of the national trial lawyers association, the American Association of Justice (AAJ), and Workers’ Injury Law & Advocacy Group (WILG).

In this episode, we'll discuss questions related to Stress / PTSD Workers' Compensation claims with an expert, Jason D. Mills, Esq. partner at GGRM Law Firm.  We'll also review the changes to the Nevada Industrial Insurance Act statute NRS 616C.180 that occurred in 2019. Those changes by the Nevada legislature expanded the Workers' Compensation benefits to first responders, including dispatchers and volunteer firefighters.

    2021 Legislative Changes to Nevada's Workers' Compensation Laws

    It's that time again! Time to discuss the changes that happened to the Nevada Industrial Insurance Act and Nevada Occupational Disease Act as a result of the bills that made it to the Governor's desk during Nevada's 81st Legislative Session. We'll discuss AB 400, SB 295, and SB 289 with Jason D. Mills, Esq. partner at GGRM Law Firm. We'll go over the great news in SB 295 which was authored by Senate Majority Leader Cannizzaro and lobbied by the Professional Firefighters of Nevada (PFFN) and GGRM's very own, Jason Mills, which revises provisions relating to industrial insurance that affect first responder's heart/lung/hepatitis Permanent Total Disability (PTD) monthly benefits.   As of October 1, 2021, any police officer, firefighter, or arson investigator that is receiving Permanent Total Disability (PTD) benefits due to heart disease, lung disease or hepatitis, will be able to engage in non-police, non-fire, non-arson investigating employment and not have to worry about their Permanent Total Disability benefits being reduced or offset.  For any PTD recipients who were also retired out based on an early Public Employees' Retirement System (PERS) medical discharge, it is essential to continue to get clearance with the PERS before engaging in any gainful employment so as not to impact your PERS pension benefits.

    Reopening a Workers' Compensation Claim with Jason D. Mills, Esq.

    After a workers’ compensation claim is closed, Nevada laws place restrictions on lifetime reopening the claim unless the injured worker was off incapacitated from earning full wages for 5 or more days or on permanent partial disability. For all other injured workers, a workers' compensation claim must be reopened within one year after the claim was closed. If medical costs paid before the claim was closed are less than $800, the claim cannot be reopened. Navigating the Nevada Industrial Insurance Act, or Occupational Disease Act, is no small task. It's not only getting them the medical benefits that they're entitled to, and the indemnity or monetary benefits they're entitled to, but we're also making sure that when that claim is over when it closes when it's done, it's procedurally and factually set up as best as possible for the future.
