Why the “temporary or seasonal” test is about the employer’s need for a job duty at a particular time of year, and not about whether a task can be done year-round. Kyle also gives his take on the recent guidance for dairies, explains why planning matters, and shares the timing rule he uses: job orders filed 60 to 75 days before the date of need. TN.
