    It’s Just Like Covid - Everyone is an Expert

    His larger point is that the Dunning Kruger effect is not a partisan trait. Hawk argues it shows up just as often on the left as on the right, and he pushes back on the idea that acknowledging hard truths and respecting expertise are somehow in conflict. On the Clancy case itself, Hawk holds two things at once. He says the expanded public conversation about postpartum depression and postpartum psychosis is genuinely valuable, while also insisting the three children who died deserve to be remembered. He restates his view that the case was overcharged and reads as a not guilty by reason of insanity matter, even as the evidence points to Clancy rather than her husband.     Nobody Is Stopping Trump's Plan to Throw Away Your Ballot

    Drawing a line back to 2020 and the stretch between election night and January 6th, Hawk argues the difference now is planning. He points to reporting that ICE is building a multimillion dollar national voter database, to DHS Secretary Markwayne Mullin saying agents could appear at polling places, and to a New York Times account of federal agents combing state voter rolls without warrants. The warning extends past election day. Hawk lays out the Senate and House math, the risk that batches of mail ballots from Democratic cities could be thrown out, the Tarrant County move to close polling sites, and the January 3rd handoff when a House clerk could shape who gets seated. His closing point is blunt: the courts are the last line, and they may not move fast enough.     Should Democrats IMPEACH TRUMP a Third Time?

    From there Hawk lays out the political reality. Even with 52 or 53 Senate seats, Democrats would be far short of the Republican votes needed for conviction, and a Republican-controlled Senate might decline to hold a trial at all. He notes how Mitch McConnell pointed to the courts after January 6th, and how impeachments historically boost a president's poll numbers, as they did for Bill Clinton and for Trump twice before. Weighing it out, Hawk points to an open 2028 White House, a Senate GOP already tired of Trump after the primary losses of John Cornyn, Bill Cassidy, and Thom Tillis, and his own mixed feelings. He explains why he leans toward moving on rather than grinding Congress to a halt, while acknowledging the constitutional argument for using the remedy the founders provided.     Some Good News - Senate Polling Shows Democrats Leading in 8 Races

    From there he runs the board on eight Senate races where Democrats are polling ahead: Mary Peltola in Alaska, Jon Ossoff defending Georgia against Mike Collins, Josh Turek in Iowa, Troy Jackson taking on Susan Collins in Maine after Graham Platner exited the race, Abdul El-Sayed in Michigan against Mike Rogers, Roy Cooper with a commanding lead in North Carolina, Sherrod Brown mounting a comeback in Ohio, and James Talarico leading Ken Paxton in Texas. Hawk spends extra time on Talarico, whose polling shows unusually strong support among Black voters in Texas compared with past Democratic nominees, and on Paxton, whose fundraising has cratered to the point that Donald Trump is planning a rally for him.     This is Sad and Embarrassing

    Two genuinely ridiculous things crossed Hawk's desk today, and they rhyme. First, The Atlantic reports that with his approval parked in the low thirties, the president sat his advisors down to figure out how to spend a roughly $400 million super PAC war chest, and the master plan they landed on is more of himself. The diagnosis from his own team is that voters just haven't been properly introduced to his accomplishments yet, which is a bold thing to say about the most photographed man alive. The cure is ads. About him. Problem solved. Then there's the convention. Parties hold conventions in presidential years. Everybody knows this except, apparently, the people planning a two night Trump convention in Dallas on September 9th and 10th, keynote speaker both nights, him. It lands on NFL opening night, which is a fight with the NFL that the NFL does not know it is in and will win anyway. And the cover charge is the punchline: House candidates reportedly pay their own super PAC to walk in, tiered all the way up to a six figure package Hawk reads out with the delight it deserves. His take, more or less: if you were trying to lose on purpose, it would look a lot like this.     The Lindsay Clancy Trial: How Expert Witnesses Actually Work

    The center of it is expert testimony. When a defendant's mental state is the whole question, both sides bring in psychologists, and everything those witnesses say is opinion, not fact. Hawk walks through what it takes to qualify an expert, why the phrase to a reasonable degree of psychological certainty matters, and why cross examination is where these witnesses are really tested. One clip shows a prosecution expert asked repeatedly what he was paid, and struggling to give a number, which is a moment juries tend to remember. The sharpest sequence is the defense attorney taking a line from the prosecution's own opening statement and reading it back to one of the prosecution's own witnesses, who then undercut the prosecution's theory of motive and mental state. Hawk explains why an opening is a promise to the jury, and what it costs when that promise is not kept. Closing arguments are expected next, after jury instructions, with deliberations to follow.
