The Challenges of Funded Research in R&D Tax Credits

Customer-driven research is not automatically excluded from the R&D tax credit. But passing the four-part test is only the starting point. Host Dave McGuire joins David Seibel, EA, and Tanner Niehaus, CPA, to unpack the funded research exclusion and two key considerations for eligibility: economic risk and substantial rights to the research. The conversation explores how payment terms, warranty provisions, and intellectual property rights affect the analysis, with practical examples involving software development, manufacturing, contract manufacturing, and design-build projects. The team also compares Section 41 and Section 174 research contract standards, discusses outsourced foreign research, and explains why changing contract terms requires balancing potential tax benefits with business risk. Listen for the questions CPAs should ask before ruling out customer-driven R&D—or assuming a project qualifies. From Compliance to Advisory: The Evolution of the CPA

CPA firms are being asked to deliver more than tax returns. What does the shift from compliance to advisory look like in practice? On this episode of Let’s Talk Tax, host Dave McGuire and guest Mike Hammel, MAcc, discuss how CPA firms can build deeper client relationships while navigating time constraints, staffing challenges, AI, and automation. They explore the value of partnering with specialists, identifying compliance risks alongside tax savings opportunities, and matching strategies such as cost segregation and R&D planning to each client’s goals. They also share how smaller firms can use their close client relationships as an advantage and why developing an advisory mindset across the team takes intentional effort. The Bigger Picture: Connecting Property Tax, Fixed Assets, & Location Strategy

When a client is expanding, buying equipment, building a new facility, or entering a new state, property tax, fixed assets, and location strategy shouldn’t be separate conversations. In this episode of Let’s Talk Tax, Dave McGuire is joined by Ben Worrell, MBA, and Rebecca Patterson to explore how connecting federal, state, and local tax considerations can uncover opportunities throughout periods of business growth and change. Using a manufacturing facility as an example, they discuss why early planning matters for state and local incentives, when property tax considerations should enter the conversation, and how depreciation and fixed asset strategies can affect the overall tax picture. They also share questions CPAs can ask to better understand what’s changing within a client’s business and position themselves as strategic advisors throughout the planning process. As always, check us out on YouTube, LinkedIn, or Instagram. IC-DISC: A Powerful Strategy Many Exporters Miss

The IC-DISC has existed for decades, but many qualifying manufacturers and exporters have never evaluated the opportunity—or assume it disappeared after recent tax reform. In this episode of Let’s Talk Tax, Dave McGuire and Greg Lambrecht, CPA, explain how an Interest Charge Domestic International Sales Corporation can help qualifying businesses convert a portion of export income into qualified dividend income. For pass-through owners, the resulting rate arbitrage may produce approximately 5.8% to 6% in tax savings, while certain closely held C corporation structures may offer additional planning opportunities for owners and key employees. They discuss direct and indirect exports, domestic-content and substantial-transformation requirements, qualifying services performed abroad, and the three primary methods used to calculate an IC-DISC commission. Greg also explains how transaction grouping and expense allocation may increase the benefit, why an overall business loss does not necessarily eliminate the opportunity, and why businesses must establish an IC-DISC before eligible sales occur. For CPAs advising manufacturers, exporters, and companies operating across borders, this conversation highlights an established incentive that deserves a fresh look. Training for Tomorrow: AI, Tax Incentives & Workforce Strategy

As businesses invest in artificial intelligence, they face new questions about workforce training, data security, and potential tax opportunities. In this episode of Let’s Talk Tax, host Dave McGuire and guest David Seibel, EA, explore how AI-related investments may intersect with the R&D tax credit, the proposed AI Workforce Training Act, startup payroll tax credits, and Section 174. David explains why developing proprietary AI models or automated systems may qualify for the R&D tax credit while implementing existing tools may not. They discuss how the four-part test applies to AI projects, including technical uncertainty and experimentation, and examine examples involving manufacturing automation, internal-use software, computer leasing costs, and AI tokens. They also discuss protecting confidential client information, how AI adoption may change wage-driven qualified research expenses, and why companies using foreign research or software development teams must continue considering 15-year Section 174 amortization. Be Curious: Finding Specialty Tax Opportunities in Any Size Business

Specialty tax opportunities are not limited to large corporations—and a business does not need millions in revenue or hundreds of employees to benefit. Dave McGuire hosts Mike Hammel, MAcc, to explore how CPAs can identify specialty tax opportunities within closely held manufacturers, contractors, healthcare practices, software startups, exporters, and family businesses. They explain why fit depends more on what a business is doing than how large it is. Through practical examples, Dave and Mike discuss R&D tax credits, cost segregation, property tax appeals, location advisory incentives, IC-DISC, international tax compliance, and transfer pricing. They also address common misconceptions and explain why CPAs should ask clients about growth plans, hiring, facility investments, equipment purchases, exports, acquisitions, and ownership transitions throughout the year. The central takeaway: Be curious. Asking better questions can help advisors identify opportunities earlier and connect tax strategies with each client’s broader goals.
