    The Million-Euro Phone Call: When Verifying a Carrier Isn't Really Verification

    Welcome to another episode of the Forward Podcast 🎙️ This time, we're looking at one of the fastest-growing threats in European road transport: phantom carrier fraud. It begins with what looks like a routine subcontracting request, complete with convincing documents, a professional phone call, and a truck arriving exactly as expected. But behind it is a criminal operation that has already done its homework 🚚. We unpack a 2024 German court decision where more than €1.3 million of cargo disappeared - and the insurer still required the freight forwarder to bear 30% of the loss because the verification process wasn't considered sufficient ⚖️. The judgment sends a clear message: for high-value cargo, simply trusting documents and making a phone call is no longer enough (OLG Düsseldorf (18 U 212/22). Three key takeaways: 🕵️ Phantom carrier fraud is highly organised. Criminals impersonate legitimate transport companies, clone genuine licences and registrations, and often know shipment details before they contact the forwarder - making the fraud extremely convincing. 📞 Calling the phone number in the email is not independent verification. The Düsseldorf Court made it clear that verifying a carrier using contact details supplied by the very party you're trying to verify is not meaningful due diligence. Independent checks matter. 🛡️ Insurance doesn't replace risk management. Even though the forwarder was a victim of sophisticated fraud, the court upheld the insurer's decision to reduce the claim payment because the forwarder had failed to meet the required standard of care for such a high-value shipment.
