Lindsay Clancy Trial: Did the “Mortal Sin” Question Cross the Line? With Special Guest Susan Constantine

One question from the Commonwealth prompted an immediate sidebar in the Lindsay Clancy trial. After confirming that Clancy’s mother-in-law was Catholic, the prosecutor asked whether murder is considered a “mortal sin.” Did that moment help establish that Clancy understood right from wrong, or did it risk turning jurors against the prosecution? Criminal defense attorney and former prosecutor Joshua Ritter is joined by jury consultant and body language expert Susan Constantine to analyze the controversial exchange, Clancy’s emotional reactions in court, the defense’s first witnesses and whether Clancy should testify. Justin Shepherd from JustInTheNickOfCrime also joins Josh to examine Dr. Paul Zeizel’s testimony about delusions and intrusive thoughts before breaking down the opening days of Duane “Keffe D” Davis’s trial for the murder of Tupac Shakur. 00:00 Lindsay Clancy Trial Day 15 01:03 Josh Reports From Plymouth 04:16 Jury Consultant Susan Constantine Joins 21:07 Prosecutor’s “Mortal Sin” Question 25:17 Will Lindsay Clancy Testify? 29:28 Justin Shepherd on the Clancy Defense 35:36 Dr. Zeizel on Delusions and Intrusive Thoughts 46:46 Keffe D Trial and Tupac Shakur’s Murder 50:41 Prosecution and Defense Opening Statements 57:28 Could Suge Knight Testify? 60:07 Is the Religion Question Grounds for Appeal? 64:23 Upcoming Trial Coverage and Show Schedule ABOUT SUSAN CONSTANTINE: Susan Constantine is a nationally recognized body language expert, jury consultant and media analyst with experience examining high-profile trials. Who Killed Tupac Shakur? The Case That Took 30 Years to Reach Trial

Nearly 30 years after the murder of Tupac Shakur, Duane “Keffe D” Davis is going on trial. Opening statements are scheduled for Monday, August 17, in Las Vegas. Davis has pleaded not guilty. Prosecutors do not accuse him of firing the fatal shots. Instead, they allege that he orchestrated the retaliatory attack and provided the gun used in the 1996 drive-by shooting. Ahead of opening statements, Courtroom Confidential presents an updated edition of our Case Notes investigation into one of the most infamous unsolved murders in music history. Criminal defense attorney and former prosecutor Joshua Ritter examines the events that led to Tupac’s murder, including the East Coast-West Coast rivalry, the MGM Grand fight involving Orlando Anderson, the fatal shooting on the Las Vegas Strip, the deaths of several key figures and the decades-long investigation that ultimately led to Davis’s 2023 arrest. Josh also examines Davis’s past statements about the shooting, his law-enforcement interviews, the disputed proffer agreement and the legal challenges prosecutors faced in transforming those accounts into admissible evidence. The episode concludes with an update on the major pretrial rulings that will shape the case, including decisions allowing prosecutors to introduce Davis’s memoir, his recorded law-enforcement interview, evidence seized during the 2023 search and evidence concerning his alleged gang affiliation. 0:00 Keffe D Trial Preview 2:06 East Coast vs. West Coast Rivalry 3:49 The MGM Grand Fight 7:02 Tupac Dies and Witnesses Stay Silent 8:39 The Murder of Biggie Smalls 9:42 Alleged Political Pressure in Las Vegas 10:22 The Original Suspects 11:58 Who Is Duane “Keffe D” Davis? 13:39 The Federal Proffer Agreement 14:27 Davis Describes the Shooting 15:15 The Secret Police Interview 16:39 Public Statements Revive the Case 17:34 The 2023 Search, Indictment and Arrest 20:56 Major Developments Before Trial 22:41 Jury Selected and Live Trial Coverage Watch the Keffe D trial live on our sister channel, Courtroom Confidential: Live Trials -  https://www.youtube.com/@CCLiveTrials Check out more Case Notes episodes here: https://youtube.com/playlist?list=PLiteA2x_mfo38jNaaXqhQzX6ZWvDOEf6c&si=Dtz0GKeI5kdK0gOD About Joshua Ritter: Joshua Ritter is a criminal defense attorney and former prosecutor providing legal commentary and analysis on the nation’s biggest true crime cases. Luigi Mangione Admitted the Killing. Did He Just Outsmart Prosecutors?

Luigi Mangione admitted in federal court that he planned and carried out the killing of UnitedHealthcare CEO Brian Thompson, pleading guilty to two federal stalking charges without a plea agreement, sentencing promise or guarantee of leniency. The plea exposes him to a possible life sentence, but it may also give his attorneys a basis to argue that New York’s broader double jeopardy protections bar the state murder prosecution. Criminal defense attorney and former prosecutor Joshua Ritter explains why Mangione may have chosen to secure the federal conviction first, what his courtroom admissions could cost him if the state case survives and whether the plea was a surrender or the biggest legal gamble of his case. Josh also breaks down the major rulings from Alex Murdaugh’s pretrial hearing in South Carolina, including the change of venue, additional DNA testing and whether prosecutors can use Murdaugh’s sworn testimony from his first trial. Plus, Josh answers viewer questions about the Lindsay Clancy trial, Massachusetts insanity law and what could happen if she is found not guilty by reason of insanity. Lindsay Clancy Trial: Did Graphic Testimony Backfire on the Prosecution? With Special Guest Elyse Hershon

Joshua Ritter is joined by attorney Elyse M. Hershon to break down Day 12 of the Lindsay Clancy murder trial. Jurors heard from mental health counselor Latiesha Dukes, who treated Clancy in the weeks before the deaths of her three children. Dukes testified that Clancy reported intrusive thoughts but showed no signs of mania, paranoia or psychosis. Later, graphic medical examiner testimony caused Clancy to openly sob, prompting the judge to call a recess. Then, former federal prosecutor Neama Rahmani joins Josh to discuss major developments in the Luigi Mangione cases. A judge ruled that the jury in Mangione’s upcoming New York state murder trial will remain anonymous amid concerns about harassment and outside influence. The court also approved an overflow courtroom with an internal video feed ahead of jury selection on September 8. Meanwhile, Mangione’s attorneys and federal prosecutors are expected to discuss a possible plea agreement during a federal court conference Friday. Plus, Nick Reiner has been indicted on two counts of murder in the deaths of his parents, director Rob Reiner and Michele Singer Reiner. The grand jury indictment adds special-circumstance allegations of multiple murders and lying in wait, eliminates the need for a preliminary hearing and makes Reiner eligible for life without parole or the death penalty if convicted. Reiner has pleaded not guilty, and prosecutors have not announced whether they will seek capital punishment. Lindsay Clancy Trial: Defense Grills Psychiatrist Over Missed Warning Signs With Special Guests Julia Jenaé & Joel Waldman

One day before Cora, Dawson and Callan were killed, Lindsay Clancy told psychiatrist Dr. Jennifer Tufts that she had felt numb for 17 days, had a racing heart and was depressed. Yet Tufts testified that Clancy repeatedly denied thoughts of harming herself or others and showed no signs of psychosis. Former prosecutor and criminal defense attorney Joshua Ritter and Court TV’s Julia Jenaé examine whether the defense exposed serious warning signs that were missed—or successfully shifted the jury’s focus away from Clancy’s criminal responsibility. Later, Joel Waldman of Surviving the Survivor, who attended Courtney Clenney’s plea and sentencing, takes us inside the courtroom. Clenney pleaded guilty to manslaughter with a deadly weapon and received six years in prison followed by five years of probation for killing Christian Obumseli. Josh and Joel discuss why prosecutors accepted the plea, the risks they faced at trial and whether the sentence delivers meaningful accountability. 00:00 Were Lindsay Clancy’s warning signs missed? 01:08 Show introduction 03:54 Julia Jenaé joins the discussion 11:37 Psychiatrist never saw Clancy in person 17:33 The two hotline calls 23:55 Clancy’s final appointment before the killings 29:48 The “pressured speech” note dispute 35:43 Courtney Clenney’s plea and six-year sentence 41:04 Christian Obumseli’s family addresses the court 42:43 What it was like inside the courtroom 46:17 Why prosecutors offered Clenney the plea deal 51:21 Did Clancy’s treatment affect criminal responsibility? 66:08 Viewer questions and announcements Follow Julia Jenaé! https://x.com/JuliaCourtTV https://www.instagram.com/juliacourttv/?hl=en Follow Joel Waldman / Surviving the Survivor! https://www.youtube.com/@SurvivingTheSurvivor https://x.com/podcaststs https://www.instagram.com/survivingthesurvivor Follow Josh: https://x.com/JoshuaRitterESQ https://www.instagram.com/joshuaritteresq/ https://www.joshuaritter.com/ https://www.thecourtroomconfidential.com/ Merch: https://shop.thecourtroomconfidential.com/ Support our moderators: https://buymeacoffee.com/courtroomconfidential DISCLAIMER: The information in this video is for educational purposes only. Lindsay Clancy Trial: Her Doctors Saw No Psychosis. What Does That Prove? With Special Guest Dr. Josef Witt-Doerring

Joshua Ritter is joined by board-certified psychiatrist and former FDA medical officer Dr. Josef Witt-Doerring to analyze a critical day of psychiatric testimony in the Lindsay Clancy murder trial. Jurors heard from two psychiatrists who treated Clancy before the deaths of her children, Cora, Dawson and Callan. Dr. Alia Goodheart testified that Clancy showed no signs of psychosis and was considered a low safety risk when she left McLean Hospital 19 days before the killings. Dr. Jennifer Tufts described initially treating Clancy for anxiety and depression, saying Clancy denied experiencing suicidal or homicidal thoughts, hallucinations or other signs of psychosis. Josh and Dr. Josef break down what the psychiatrists’ testimony establishes, what it does not and how it could affect Clancy’s lack-of-criminal-responsibility defense. Could postpartum psychosis have gone undetected during those evaluations? How much can doctors rely on a patient’s self-reporting? And what does the absence of documented psychosis weeks or months earlier prove about Clancy’s mental state at the time of the killings? Plus, Josh covers two major case updates: • Hawaii doctor Gerhardt Konig challenges his attempted manslaughter conviction, claiming jurors misunderstood the judge’s instructions. Konig claimed he acted in self-defense when he attempted to push his wife, Arielle Konig, off a cliff. •  OnlyFans model Courtney Clenney prepares to formally accept a plea agreement in the death of Christian Obumseli at a hearing Monday Follow Dr. Josef Witt-Doerring: https://www.youtube.com/@taperclinic https://x.com/DrJosefWD https://www.instagram.com/drjosefwittdoerring/ About Joshua Ritter: Joshua Ritter is a criminal defense attorney and former prosecutor providing legal commentary and analysis on the nation’s biggest true crime cases. Lindsay Clancy Trial: Did the Prosecution’s Own Witness Help Her Defense? With Special Guest Paul Mauro

Criminal defense attorney and former prosecutor Joshua Ritter is joined by Sierra Gillespie, host of Law&Crime’s Scandal, to break down the latest testimony in the Lindsay Clancy trial. Sierra has been closely reporting on the case as prosecutors present their evidence against Clancy, who does not dispute that she killed her three children, Cora, Dawson and Callan, but argues that she was not criminally responsible due to postpartum mental illness. Today, prosecutors called the Clancy family’s former nanny, Elaine Rossi, who described Lindsay as “a wonderful mother” who loved her children and was deeply concerned about their safety. Rossi also recalled Clancy struggling with sleep, taking medication and losing a significant amount of weight, but said Clancy never disclosed intrusive thoughts or thoughts of harming herself.  Josh and Sierra discuss whether the prosecution’s own witness ultimately helped or hurt Clancy’s insanity defense, along with the toxicology, medical and forensic evidence presented this week. Then, Fox News analyst and The Weekly Rap Sheet co-host Paul Mauro joins Josh to analyze where the Clancy case stands and what prosecutors must prove to establish that she was criminally responsible. Josh and Paul also break down the latest developments in the Luigi Mangione case, including the defense’s push for greater public and media access as his state murder trial approaches.
