    The Property Practitioners Regulatory Authority fails to withdraw it's unlawful BEE policy

    The Property Practitioners Regulatory Authority (PPRA) has been denying Fidelity Fund Certificates (FFCs) to property practitioners based on BEE status since at least April 2024, preventing them from legally operating. Sakeliga has demanded the PPRA provide a written undertaking to withdraw and reverse the policy, prompted by recent reports of a temporary hold by the PPRA. The PPRA has not officially changed its position and is ignoring demands to publicly withdraw the policy, reopen denied FFC applications, and commit to avoiding similar BEE-based restrictions in the future.

    Sakeliga wins special punitive costs order against North West Government and COGTA

    Sakeliga has obtained a punitive costs order against the Minister of Cooperative Governance and Traditional Affairs (COGTA) and the North West Government.   The court found that they were “trying to circumvent their constitutional duty” and that their opposition to Sakeliga was “totally unnecessary.”

    Update: Three new harmful Acts signed by President Ramaphosa

    President Cyril Ramaphosa’s enactment on 23 July 2024 of three new pieces of legislation poses grave threats to the economic environment. Once implementation by the multi-party government starts, the Public Procurement Act, National Small Enterprise Amendment Act, and Climate Change Act will increase the cost of doing business in South Africa while accelerating state failure. Each is potentially harmful on its own and all add to an ominous series of legislative threats along with the recently signed NHI Act, employment equity regulations, and third-wave BEE directives.

    President Cyril Ramaphosa Signs New Law on State Procurement [Sakeliga Press Release]

    The Public Procurement Act, signed today, is a recipe for accelerated state failure. This Act seeks to severely restrict state entities' procurement choices, increasing expenses and diminishing service quality whilst potentially facilitating corruption on an unprecedented scale.     The 2024 elections and beyond: Sakeliga's strategy and what we will do next

    The national election has ushered in more fluid and competitive political dynamics. Most analysis is currently focussed on how this may lead to better government and state administration, but at Sakeliga we also ask how it affects our long-term strategic aim. In the increasing political complexity, we see opportunities not only to improve the government’s impact on the business environment but also to ultimately redefine the state’s role in the economy.  Because elections emphasise short-term political matters, it is easy to forget that the role of the state itself can, and at times must, be changed. Throughout its history, the state has both expanded and been rolled back, depending on the strength and authority of other organised sections of society able to think well beyond five-year election cycles.  At Sakeliga, we consider the coming decade of increasing political complexity an opportunity to reform governance, yes, but also to fundamentally renegotiate the state-business relationship.
