Can You Build Trust When Lawyers Have Gone Rogue? | #9

Lawyers love to argue   I suspect that doesn't surprise you But it may surprise you that some lawyers also get physical.  ·      Like that time a lawyer had it out for me and threw me against the wall ·      What would you do with your back literally up against the wall? ·      And a hostile lawyer screaming in your face.  Would you retaliate?  Just what would you do? I CREATED TRUST…… Suppose trust of opposing counsel was a helper and not a hurter in a case. What if there was a way that developed trust that counteracts every one of the things that I've talked to you about up to now,  ·      trust that lessens your caseload  ·      trust that lessens the amount of time that you have to put into a case,  ·      trust that creates opportunities for you to resolve the case  ·      Trust that creates no motion work.  ·      Trust that doesn't risk appeals.  ·      Trust that leads to mediations that resolve your case. ·      That means killing your adversary softly ·      Killing your adversary with kindness. ⚖️ I believe Successful Resolutions through Mediation are possible...when you implement the Relational Mediation Method I teach in each episode. ☎️ BOOK YOUR FREE 20-MINUTE C0NSULT to learn how mediation can save you time, reduce stress, reduce costs and make happier clients and happier you. 📍 CONNECT on LinkedIn 📍 FOLLOW ME on FaceBook 💻 https://www.smarttomediate.com 📺 YouTube

Play the cards you have for a successful mediation|#4

Are trial lawyers modern day gamblers?  Does gambling play a role in a successful mediation?  My intent was  to explore  the relationship between a gamblers mentality, love of competition, and the role of a lawyer in the personal injury field.  Is it ever appropriate to gamble with your clients case?   Shouldn't you only be gambling with your own money and not that of others? As I was preparing, the Trump-Zelenskyy Oval Office "mediation" fell apart.  Then I heard Trump say:  "You are gambling with your peoples lives" and "You are gambling with World War III.  Then he told Zelenskyy he did not have the cards to play.  At that moment, I knew this podcast was going to touch something relevant to many cases and the attorneys who do personal injury.   I understood the gambling mentality.  Shucks, I struggled with it myself in the day. The first part of the episode deals with the analysis of the smart approach to risk taking in a case and how mediation can address that.   The second part of the episode gives my analysis of what happened at the meeting/mediation. What went wrong, and discusses whether it can be fixed.  Preventing war is a noble cause.  The stakes are high.  But the reality is that what we do in the claims field is just as important to our clients.  We should never gamble on an outcome with our clients money.
