With the increasing diversification of labor relations, problems such as ambiguous liability in mixed employment, disputes over the calculation of double wages for failure to sign written labor contracts, abuse of non-compete clauses, and difficulties in characterizing re-employment of elderly workers have occurred frequently, with inconsistent judicial standards across regions. Interpretation (II) responds to these pain points in a targeted manner: it clarifies the subject of liability in subcontracting/affiliation employment, regulates the determination of labor relations and joint liability in mixed employment by affiliated enterprises; refines the calculation method, exemption circumstances of double wages and rules for labor contract renewal to prevent enterprises from evading the obligation of signing open-ended labor contracts; strengthens the validity review of non-compete clauses to balance the protection of enterprises' trade secrets and workers' right to choose employment; and adjusts the rules for determining the employment relationship of elderly workers to adapt to the employment needs of an aging society.
