    La nascita della marcatura CE

    Send us Fan Mail La marcatura CE nacque indirettamente da una controversia sul liquore francese Crème de cassis. Nel 1979 la Germania ne bloccò l’importazione perché il suo grado alcolico era inferiore a quello richiesto dalla legge tedesca. L’importatore ricorse alla Corte di Giustizia Europea, che stabilì che tali restrizioni non giustificavano ostacoli alla libera circolazione delle merci. La celebre Sentenza Cassis de Dijon aprì così la strada all’eliminazione di molte barriere protezionistiche. Da essa derivò il passaggio, nel 1985, dal “Vecchio approccio”, in cui le Direttive coprivano ogni dettaglio tecnico, al “Nuovo approccio”: Direttive e Regolamenti definiscono solo requisiti essenziali e obbligatori, mentre le norme armonizzate forniscono specifiche tecniche volontarie. La marcatura CE fu formalmente introdotta nel 1993 con la Decisione 93/465/CEE, come “passaporto” per la libera circolazione dei prodotti nello Spazio Economico Europeo. Il simbolo, creato da Arthur Eisenmenger, attesta la conformità ai requisiti di sicurezza, salute e ambiente previsti dall’UE e vale per prodotti nuovi o importati, anche di seconda mano. Esiste il mito del “China Export”, ma privo di fondamento. Come esercizio, si può verificare la marcatura CE degli oggetti di uso quotidiano e capire a quali Regolamenti sono soggetti.

    The Birth of the CE Marking

    Send us Fan Mail The CE marking originated indirectly from a dispute over the French liqueur Crème de cassis. In 1979, Germany blocked its import because its alcohol content was lower than the national requirement for liqueurs. The importer appealed to the European Court of Justice, which ruled that such restrictions could not justify obstacles to the free movement of goods. The famous Cassis de Dijon judgment thus paved the way for dismantling many protectionist barriers. This led, in 1985, to the shift from the “Old Approach,” where Directives covered every technical detail, to the “New Approach”: Directives and Regulations define only essential and mandatory requirements, while harmonized standards provide voluntary technical specifications. The CE marking was formally introduced in 1993 through Decision 93/465/EEC as a “passport” enabling the free circulation of products within the European Economic Area. The symbol, designed by Arthur Eisenmenger, certifies conformity with EU safety, health, and environmental requirements and applies to new or imported products, including second‑hand ones. There is also the myth of the “China Export” logo, though it is unfounded. As an exercise, one can check CE markings on everyday items and consider which Regulations they must comply with.

Come Furio di “Un sacco bello” di Verdone, o Morpheus di “Matrix”?  Secondo me sì!  Tenendo presente che la realtà non è così semplice e sempre riconducibile a categorie fisse: siamo tutti ora l’uno, ora l’altro personaggio… e in momenti diversi.

    Come strutturare la documentazione tecnica

    Send us Fan Mail La documentazione tecnica per l’MDR deve essere non solo conforme agli Allegati II e III, ma anche facilmente consultabile dal product assessor. Una struttura disordinata o informazioni difficili da reperire generano ritardi, non conformità e perdita di tempo, soprattutto con le scadenze MDD imminenti. La linea guida Team NB sulla sottomissione della documentazione tecnica offre un riferimento utile: i principali motivi di ritardo sono fascicoli incompleti e mancanza di coerenza strutturale. Evitare PDF non ricercabili, indici inutilizzabili e informazioni duplicate; garantire invece completezza dei dati (inclusi i raw data dei test) e coerenza di elementi chiave come intended use e Basic UDI-DI. Quando si aggiornano i documenti, le modifiche devono essere evidenziate chiaramente e descritte nel sistema qualità. Le risposte ai rilievi devono essere complete e autosufficienti, e l’invio successivo deve includere l’intero fascicolo, non solo le parti modificate. Le traduzioni devono essere accurate e professionali. È essenziale consultare anche il regolamento specifico dell’Organismo Notificato, che può contenere requisiti aggiuntivi. Infine, è possibile richiedere un dialogo strutturato con l’Organismo per chiarimenti procedurali. In sintesi: facilitare il lavoro del product assessor significa facilitare il proprio.

    How to Structure Technical Documentation

    Send us Fan Mail Technical documentation for the MDR must not only comply with Annexes II and III, but also be easily accessible to the product assessor. A disorganized structure or hard‑to‑find information leads to delays, nonconformities, and wasted time—especially with the upcoming MDD deadlines. The Team NB guideline on the submission of technical documentation provides a valuable reference: the main causes of delays are incomplete files and lack of structural coherence. Avoid non‑searchable PDFs, unusable tables of contents, and duplicated information; instead, ensure data completeness (including raw test data) and consistency of key elements such as the intended use and the Basic UDI‑DI. When documents are updated, changes must be clearly highlighted and described within the quality system. Responses to findings must be complete and self‑contained, and subsequent submissions must include the entire technical file, not just the modified sections. Translations must be accurate and professional. It is also essential to review the specific regulations of the Notified Body, which may include additional mandatory requirements. Finally, it is possible to request a structured dialogue with the Notified Body for procedural clarifications. In short: making the product assessor’s job easier ultimately makes your own work easier.

    MDR 2.0: le novità emerse dalla "High-level conference"

    Send us Fan Mail  Il 16 marzo a Bruxelles si è tenuta la High-level conference on medical devices della Commissione Europea, dedicata a “innovazione e sicurezza del paziente” e alla proposta di revisione del regolamento sui dispositivi medici (“MDR 2.0”), presentata il 16 dicembre 2025. Il commissario europeo Olivier Várhelyi ha riconosciuto che l’attuale MDR, adottato nel 2017 in risposta a gravi incidenti, non ha garantito un corretto equilibrio tra rigore normativo e funzionalità del sistema. La revisione mira a razionalizzare il quadro regolatorio, mantenendo la sicurezza del paziente come obiettivo centrale.  È stata inoltre discussa una proposta separata di modifica dell’Allegato VII sugli Organismi Notificati, con tempistiche rigide per le valutazioni di conformità, fortemente contestate dagli stessi organismi.  Rainer Becker (DG SANTE) ha illustrato l’approccio più “su misura” dell’MDR 2.0: riduzione degli obblighi di aggiornamento dello PSUR, possibile riclassificazione di alcuni accessori e allentamento delle attività di sorveglianza, inclusa l’eliminazione di audit non annunciati e del limite quinquennale dei certificati.  Restano però forti dubbi sull’impatto di tali misure sulla sicurezza del paziente e nessuna indicazione chiara sui tempi di adozione del nuovo regolamento. L’atmosfera finale è stata di cauto ottimismo misto a scetticismo.

    MDR 2.0: news from the "High-level conference"

    Send us Fan Mail  On 16 March, the High-level conference on medical devices was held in Brussels, organized by the European Commission and focused on “innovation and patient safety,” with particular attention to the proposed revision of the Medical Devices Regulation (“MDR 2.0”), presented on 16 December 2025. European Commissioner Olivier Várhelyi acknowledged that the current MDR, adopted in 2017 in response to serious incidents, has failed to strike an appropriate balance between regulatory stringency and system functionality. The revision aims to streamline the regulatory framework while keeping patient safety as the central objective.  A separate proposal to amend Annex VII on Notified Bodies was also discussed, introducing strict timelines for conformity assessments—an approach strongly opposed by the Notified Bodies themselves.  Rainer Becker (DG SANTE) illustrated the more “tailored” approach of MDR 2.0, including reduced PSUR update requirements, potential reclassification of certain accessories, and a loosening of surveillance activities, such as the removal of unannounced audits and the five-year validity limit for certificates.  However, significant concerns remain regarding the impact of these measures on patient safety, and no clear timeline was provided for the adoption of the new regulation. The overall mood at the conference was one of cautious optimism mixed with skepticism.
