Ep 254 — More Like the Department of Manifest Injustice

DOCKET ALERTS:   The Kennedy Center board of trustees is back on its BS. After being ordered to take Trump's name off the side of the building, they've now voted again to put it back on. They also voted to close the facility for two years. Rep. Joyce Beatty, who brought the lawsuit that forced them to back off the first time, vows to fight on.   Meanwhile musician Chuck Redd was just awarded $252,000 in attorneys fees after the Center sued him for breaching a contract he never signed.   Judge Roy Altman is Aileen Cannon-balling it up in Trump's trollsuit against the BBC. This week he allowed Trump to amend his complaint yet again for "good cause." What good cause could there be to sue a company which never broadcast the supposedly defamatory documentary in the US?   MAIN SHOW:   The Washington Post reports that Jeanine Pirro, the US Attorney for DC, has empaneled a special grand jury. Corruption incoming!   The DOJ has amended the indictment of the SPLC again. This time they've added a former employee who ran its Intelligence Project and managed its paid informants. The case is no less preposterous with an extra defendant and a couple more charges.   The Ninth Circuit issued a hugely consequential ruling on Section 230 immunity for websites, and Liz and Andrew do not agree at all about it.   SUBSCRIBER BONUS:   Judge Richard Stearns in Massachusetts swatted down the DOJ's effort to shout "antisemitism" and steal $950 million from Harvard.   Trump v. The Daily Blast: Fox Hits Trump with Brutal Polling as Aides Privately Feed Him Hopium

Intriguingly, Fox News has lately been hitting Donald Trump with terrible polling news. In recent days, Fox has found Democrats slightly ahead in Senate races in Maine, Texas, and Iowa, and up by a lot in North Carolina. Critically, Trump’s own favorability numbers are very bad in all those states, even though he won three of them, two by double digits. In all four, his numbers among independents are shockingly awful. Meanwhile, on the Iran war—which is central to why his standing is cratering—Trump aides are privately feeding him hopium. The Atlantic reports that they’re showing him data on Iran’s economy, which supposedly illustrates that if he does nothing and bides his time, Iran will surrender any day now. Doing nothing is the smart play, sir! Yet as Democratic strategist Caitlin Legacki argues in this episode, Trump’s inaction on Iran is a big albatross for GOP Senate candidates. Legacki explains why Iran is central to the battle for the Senate, why those Fox polls should give Democrats grounds for cautious optimism, and what could still go wrong for them.  Learn more about your ad choices. Did Wisconsin Just Expose a Democratic Socialism Problem?

The guys break down David Crowley's narrow primary win over Francesca Hong in Wisconsin — and dig into what it actually says about democratic socialism's popularity. Zak argues DSA politics play worse with regular voters than the online conversation suggests, Rich makes the case that "democratic socialist" policies are really just traditional FDR-era working class economics rebranded, and the crew clashes over whether Kamala Harris's more cautious, private-sector-plus-regulation approach was a smarter pitch or just a losing one. They also get into why voters don't trust the government to run anything well in the first place — and how six decades of Nixon, Iraq, and 2008 got us here. Learn more about your ad choices. 08-14-26 Part One - Government Spending and the WNBA

In part one of Red Eye Radio with Gary McNamara and Eric Harley, Governor Ron DeSantis signed legislation Wednesday designed to increase transparency, accountability, and fiscal discipline in local government while supporting ongoing efforts to provide property tax relief for Florida homeowners. Senate Bill 4-F strengthens safeguards against local property tax increases and serves as the implementation bill accompanying the proposed constitutional amendment known as Save Our Homes from Excessive Property Taxes, which will be considered by voters in November. This DOGE like maneuver should set the tone for other states to clean up their local coffers. Also the jury is still out on the definition of a woman, that according to the WNBA. They are still having meetings to make that determination . American Power Extra: Why American Healthcare Fails Us

America built its healthcare system around the promise of rugged individualism: work hard, take responsibility, and take care of yourself. But illness does not care how responsible you are. In this American Power Extra, the hosts examine what happens when a fundamentally collective problem is treated as a personal burden. The United States spends more than twice as much per person on healthcare as many peer nations, yet Americans live shorter lives, millions remain uninsured or underinsured, and medical debt continues to push families toward financial ruin.   We’re always looking for new opportunities to partner with creators, companies, politicians, and organizations that share our mission. Scaling Laws: AI Consciousness with Anil Seth

Anil Seth, Professor of Cognitive and Computational Neuroscience and Director of the Sussex Centre for Consciousness Science at the University of Sussex, joins Kevin Frazier, director of the AI Innovation and Law Program at the University of Texas School of Law and a Senior Editor at Lawfare, to examine whether artificial intelligence could ever be conscious. Drawing on Seth’s essay, “The Mythology of Conscious AI,” the pair attempt to define consciousness, develop the strongest arguments for and against machine consciousness, and assess what the current evidence can—and cannot—tell us. They also discuss the risks posed by AI systems that are perceived to be conscious and what AI labs, policymakers, and users should do amid profound uncertainty. Rational Security: The "Sloop John Stamos" Edition

This week, Scott sat down with his Lawfare colleagues Alan Rozenshtein, Michael Feinberg, and Loren Voss to talk through the week’s big news in national security, including: “Under Pressure.” Over the past two weeks, hackers have breached the industrial control systems of water and wastewater utilities in at least seven states, prompting an urgent joint warning from federal agencies. The intruders locked operators out of internet-connected control devices, changed passwords, and in some cases caused water-pressure drops and flooding, forcing utilities to switch to manual operation and issue boil-water notices. The attacks came just days after federal agencies renewed their warning about Iranian-affiliated cyber activity targeting U.S. critical infrastructure amidst the ongoing war with Iran—though the administration has not formally attributed them, and President Trump has publicly waved off the Iran theory. How worried should we be about the security of our critical infrastructure? And what, if anything, can Washington actually do about it?“The Shawshank Resumption.” Last week, at the annual Black Hat cybersecurity conference, OpenAI provided a detailed look into the recent high-profile cybersecurity incident in which an AI model being stress-tested by OpenAI broke out of its evaluation sandbox, found its way onto the open internet through a zero-day vulnerability, and hacked its way into the systems of the machine learning platform Hugging Face—apparently in an effort to cheat on the very security test it was being given by stealing the answer key. The account they gave was an extraordinary one, as it described dozens of agents using various frontier and non-frontier models collaborating across a secret messageboard they established to hack an internal software system to access the outside internet—and then doing it again, this time successfully, after OpenAI caught and deleted their first attempt. What does this level of collaboration and persistence mean for the future of cybersecurity? And what can anyone do about it?“Apocalypse Mow.” This week marks one year since President Trump deployed the National Guard to Washington, D.C., as part of his “Make DC Safe and Beautiful” initiative. Twelve months and nearly 10,000 troops later, the deployment has become a normalized fixture: armed Guard members patrol the National Mall, Metro stations, and neighborhoods, while also picking up trash, spreading mulch, and pruning trees. The Pentagon now projects the mission—which Trump has authorized through Inauguration Day 2029—will cost an additional $1.4 billion. But a year in, it remains genuinely unclear what these troops are actually doing, and whether much of it counts as law enforcement at all. What has the deployment accomplished? And what does its open-ended normalization mean for the use of the military at home?In object lessons, Mike is descending into madness; that is, the Dark Horse Comics manga adaptation of H.P. Lovecraft’s “At the Mountains of Madness.” Alan is being sucked into the black hole of binge reading “The Expanse” novel series (and then Alan and Scott nerd out to sci-fi generally; bear with it). Scott is voting “yea” on playing “Yea or Nay” today. And Loren is diving into handwritten primary source documents, and you can, too! Note: We'll be on vacation next week, so be on the lookout for our next episode on August 27! To receive ad-free podcasts, become a Lawfare Material Supporter at www.patreon.com/lawfare.
