With new legislation being advanced in Congress that's ostensibly designed to address the regulatory failures that led to two Norfolk Southern train derailments in Ohio this year, it's important to understand the causes of that accident and what would authentically help. Glenn Kessler's Washington Post fact check along with some other mainstream coverage suggest that a narrative is emerging that limits the cause of the accident to just one issue -- overheating wheel bearings. Is there a risk that defining the cause narrowly will curb legislation that addresses more systemic problems, like meager staffing lax regulations for hazardous materials? David Sirota and The Lever have done the most comprehensive reporting to date re who is responsible for the crash. Together, we walk though Kessler's fact check, fact check it in return, and discuss the mainstream media disinformation campaign to punt blame.

This week, Briahna interviewed Matt Taibbi about a narrow concern she's had with the Twitter files archive: Despite the obvious value that Matt and other twitter files reporters have created by exposing links between the intelligence agencies and online censorship, is it fair to characterize Twitter's bias as against the right and indifferent to the left given how little we know about which documents have been turned over by Elon Musk and why? Unlike Musk, most whistleblowers are not the heads of the organizations they're informing on. Does Musk's investment in and control over Twitter demand more journalistic scrutiny? Is it possible to characterize the files reviewed so far without making broader claims about about the total archive that, at this point, can't be substantiated? Has there been sufficient inquiry into bias against the left, and has their been sufficient disclosure about the limitations Musk has put on the journalists who've been given access to the archive? The expertise on display here is extraordinary, as the two go back and forth over the Supreme Court's likely holding with respect to Biden's student debt policy based on a close reading of the oral arguments, and whether Jed's amicus brief, referenced by Kavanaugh during oral arguments, correctly raises concerns about an over-expansion of executive power.
