Freedom of Religion & Freedom of Speech in South Africa | Michael Swain – FOR SA Are freedom of religion and freedom of speech coming under increasing pressure in South Africa? In this episode of Crossfire, we speak with Michael Swain, Executive Director of Freedom of Religion South Africa (FOR SA), about significant developments surrounding the CRL Rights Commission’s Section 22 consultation process and proposals for a self-regulatory framework for the Christian sector. We discuss why FOR SA and other religious organizations remain concerned about the constitutional implications of the process, how the current proposals compare with the regulatory model rejected by Parliament in 2018, and what greater state involvement could mean for churches, ministries and religious leaders. The conversation also examines the controversial reference to the “mushrooming of charismatic churches” in South Africa’s National Security Strategy, the relationship between hate speech legislation and religious expression, and the difficult question of where legitimate accountability ends and state interference in religion begins. We ask some fundamental questions: Can freedom of religion exist without freedom of speech?Should government regulate religion—or protect the freedom to practice it?Can religious leadership be regulated without eventually influencing religious doctrine?And if the State determines who qualifies as a legitimate religious leader, who ultimately defines religious truth? We also consider what ordinary Christians and churches should be doing as the consultation process moves toward its conclusion. Ultimately, the discussion returns to a biblical principle: Christians are called to respect legitimate civil authority, while recognizing that Christ alone is the Head of the Church.
