    20 Years of EUCRIM

    Guests: Thomas Wahl, Anna Pingen, Indira Tie We're celebrating 20 years of eucrim— the academic journal that's often been described as the 'instruction manual' of European criminal law. Putting together a journal for 20 years requires a lot of time, energy, and most importantly talented personnel. Behind the scenes there are a dozen colleagues at the Institute working to ensure that eucrim comes out on time each quarter — from the editors who shape each issue's focus, to the translators who render complex legal concepts across multiple languages, to the proofreaders who ensure every citation is airtight. It is a labor of precision, patience, and genuine passion for the subject matter. Today, three of them sit down to discuss the journal — what it takes to produce it, how it has evolved over the years, and why, after 20 years, the work still feels as important as ever.     Söldner 2.0: Wenn Staaten ihr Gewaltmonopol outsourcen

    Zu Gast: Sarah Katharina Stein. Das Anwerben von kampfbereiten Fremden ist so alt wie der Krieg selbst. Man denke an etwa an die Seeräuber und ihre Kaperbriefe, die Schweizergarde, die den Papst bewacht, oder die russische Wagner-Gruppe. Vordergründig bringt die Auslagerung von Militärdienstleistungen an Private viele Vorteile: Sie sind schnell verfügbar, oft hochspezialisiert und ihr Einsatz muss nicht vor der Öffentlichkeit und den Parlamenten rechtfertig werden. Zugleich aber wirft ihr Einsatz ethische und rechtliche Fragen auf, denn für die oft in Grauzonen operierenden Firmen gibt es keine verbindlichen Regulierungen. In der neuen Folge von Doing Time, Talking Crime erläutert die Juristin Sarah Katharina Stein die Gefahren, die durch den Einsatz privater Militärdienstleister entstehen, und erklärt, warum für die Bundesregierung gerade jetzt ein guter Zeitpunkt wäre, das Thema aufs Tableau zu bringen.

Christopher Murphy is joined by Rafael Dalla Barba from the Institute's Department of Public Law. Rafael is particularly interested in exploring whether and how legal hermeneutics and metaethics can contribute to understanding the adjudication of so-called hard cases in law.     Zu Gast: Sabrina Ellebrecht. Die Polizei setzt beim Rekrutieren ihres Nachwuchses auf Diversität. Doch Bewerberinnen und Bewerber mit Migrationshintergrund stoßen beim Auswahlverfahren häufig auf unsichtbare Hürden – und das selbst in der ersten Bewerbungsphase, die noch anonym ist. Wie kann das sein? Liegt es an einer schlechteren Bildung, an mangelnden Sprachkenntnissen oder an fehlendem kulturellem Wissen?     Menschenrechte unter Druck

    Zu Gast: Johanna Bücker Klimawandel, Pandemie, Migration, Populismus, Krieg – die Welt steckt in einer sogenannten Polykrise. Manche Staaten reagieren darauf, indem sie die Menschenrechte zu beschneiden versuchen, etwa durch Pushbacks von Flüchtlingen, begründet mit Gefahr für die nationale Sicherheit. In dieser Podcastfolge nennt Rechtswissenschaftlerin Johanna Bücker aktuelle Beispiele, die derzeit vor dem Europäischen Gerichtshof für Menschenrechte verhandelt werden, und erklärt, warum Polykrisen zu einem dauerhaften Aussetzen von Menschenrechten führen könnten.

    Guest: Marthe Goudsmit Samaritter This episode looks more closely at the deeply concerning issue of image-based sexual abuse (IBSA). IBSA involves the non-consensual recording, sharing, or distribution of private sexual images or videos – a violation that can have devastating consequences for victims. To help understand what—if anything—can be undertaken to stop the spread and harm caused by IBSA,  Christopher Murphy is joined by Marthe Goudsmit Samaritter to explore not only the impact of IBSA on victims but also to discuss the legal, ethical, and social dimensions of this crime.

    Wenn Frauen getötet werden, weil sie Frauen sind

    Zu Gast: Cristina Valega Chipoco Die meisten Länder Lateinamerikas haben den Femizid – also die vorsätzliche Tötung von Frauen aufgrund ihres Geschlechts – bereits spezifisch strafrechtlich geregelt, sei es als eigenständiger Straftatbestand oder als erschwerender Umstand. In diesen Ländern verhandeln spezialisierte Gerichte diese Fälle von Gewalt an Frauen. In Deutschland hingegen ist man noch weit entfernt davon. Selbst die Definition des Begriffs „Femizid“ ist umstritten. In der neuen Podcast-Folge spricht die Wissenschaftlerin Cristina Valega Chipoco mit Host Anna Schaich über die Möglichkeiten, mit denen Justiz und Politik Femizide bekämpfen könnten.
