How To Tame the Buyer Agreement Madness

Send us Fan Mail Florida real estate is complicated — and buyer-broker agreements are a big reason why. Katrina shares a showing that went sideways when an agent showed up late, tried to get buyers to sign an agreement on the spot in the kitchen, and then had no idea what to do when he learned the seller wasn’t offering a commission. Attorney Lauren Kohl joins us to break down what’s actually required, what the forms really say, and where buyers (and agents) keep getting tripped up. We cover forced signatures, protection periods that can still cost you money after an agreement expires, the difference between real representation and transaction brokerage in Florida, how to structure shorter or more limited agreements so you’re not locked in, and why meeting at the office first usually beats signing paperwork in a driveway or parking lot. We also talk about the risk of double-dipping on commissions and why having a good attorney relationship matters when deals get complicated. If you’re a buyer trying to understand the rules, a seller wondering how compensation is being handled, or an agent who wants to do this the right way, this episode lays it out clearly with real examples from the field. Subscribe and leave a review if this helped. Questions or ready to talk about your situation in Sarasota, Charlotte, or Manatee counties? Call 941-894-9800 or visit SliceOfFlorida.com. Radio House Talk: There Is No Buying Season, and Your Local MLS Is Missing Homes

Send us Fan Mail There is no magic “season” for buying a house in Southwest Florida. Snowbirds bring more buyers, and they also bring more sellers. Some years, August and September have closed more homes than March and April. This episode is Steve Martin Smith’s guest spot on Radio House Talk with Tim Kerfin of Kerfin Inspections on WENG, alongside local agents and regulars talking through what actually moves a deal. You will hear why “marry the house, date the rate” is still the right advice after two years of people waiting for a drop that did not come. Rent paid while you wait is someone else’s mortgage. The time to buy is when you need a house, want a house, and can buy a house. Steve also walks through why a local MLS is not the whole market. Florida has multiple MLSs. A Miami brokerage can list a home in Englewood and it never shows up in the portal your agent set up. Homes.com pulls feeds from all of them, shows the listing agent instead of selling that click, and displays Matterport tours and agent remarks that Zillow and Realtor.com often bury or resell. Then the money part. On a recent closing over $600,000, the buyer paid Steve directly instead of rolling his fee into the price. The purchase price dropped, title costs and taxes dropped with it, and the buyer came out ahead. Most big brokerages do not want that conversation. From the seller’s side, a lower price also means less tax and a smaller listing fee. Also in this episode: Charlotte County inventory sitting over 12,000 homes, why a family friend who sells one or two houses a year is a bad hire, and four turnkey furnished options from Slice of Florida Realty, including a Grand Palm villa, the Sea Turtle Cottage on Venice Island, and a non-HOA pool home in Venice East in the Wellen Park school district around $400,000. You Can Cancel A Buyer Agreement With One Email

Send us Fan Mail Plenty of Saturday-morning banter with the Radio House Talk crew, then a focused look at how Florida real estate actually works right now. Steve walks through the three legal agency relationships under Florida Statute 475 — no-brokerage, transaction brokerage, and single agency — and why most deals still default to transaction brokerage even after the recent industry changes. He explains when single agency applies, why the written agreement has to be in place before you start touring homes, and how listing-side representation can affect a buyer who wants the same agent to write the offer. The conversation also covers buyer-broker agreements: exclusive year-long contracts that can lock people in versus shorter or property-specific versions that are easier to cancel. Steve shares how he structures his own agreement so a simple email ends the relationship if it isn’t a fit. Later in the hour the group turns to the Cape Coral market: elevated inventory, price resets from the 2020–21 peak, unfinished construction and open permits, and why waterfront and good water-access properties have held value better than inland inventory. Florida HOAs vs Pickup Trucks and Lettered Vehicles

Send us Fan Mail Your driveway feels like private property until a letter shows up telling you your pickup truck is “illegal” and the fines start stacking. We dig into Florida’s 2024 HOA parking law changes and why they matter for real homeowners who drive pickups, branded work vehicles, and everyday vans with ladder racks, decals, or magnetic signs. If you’ve ever wondered how an HOA can threaten a lien over a vehicle you park at your own home, this breakdown is for you. We walk through what House Bill 1203 actually does inside Florida Statute 720.3075: HOAs cannot stop you, your tenant, or your guests from parking a personal vehicle, including a pickup truck, in your driveway. We also explain the practical win for trades and small businesses, since HOAs can’t ban work vehicles in the driveway just because they have lettering, logos, or racks. Then we stress-test the rule with the state’s bright-line limit for a “heavy commercial motor vehicle,” including why 26,001 pounds is the key threshold and how it separates normal trucks from true industrial equipment. The twist is the loophole most people miss. These protections live in Chapter 720 for many single-family HOAs, but condos under Chapter 718 don’t get the same coverage, largely because condo parking is usually shared property with structural load limits. We also cover what HOAs can still enforce (vehicle tidiness, leaks, and towing on HOA-owned streets), plus the brewing legal fight where some associations claim older declarations are protected contracts unless the documents include “Kaufman language” adopting future changes in Florida law. If you live in Florida or you’re shopping for a home, hit play, take notes, and then read the parking section of the community documents for yourself. Subscribe, share this with a neighbor, and leave a review so more buyers and owners stop getting blindsided by the fine print. Hidden Costs And Legal Risk In Flat Fee Real Estate

Send us Fan Mail Read The Full Blog Post Here  A $299 flat fee real estate listing sounds like modern efficiency: get your home into the MLS, show up on every major real estate website, and keep more equity. But when you strip real estate down to “upload photos and forward leads,” you also strip out the guardrails that keep a high-stakes transaction from turning into a legal mess. We start with the core duty behind a Florida real estate license: protecting the public from economic harm caused by incompetent or dishonest practice, and we ask what happens when “limited service” becomes the default expectation. We unpack how the flat fee and limited service brokerage model actually works, why it scales so well for the broker, and where the risk quietly moves onto the seller. Think disclosures, contract contingencies, financing requirements, inspection negotiations, and the unglamorous but critical mechanics of escrow. The episode also explains why the worst problems arrive after hours, when a lender email or an inspection issue threatens to collapse the deal and your listing agreement offers no real support. Then we get specific with case studies from the Venice, Florida market: a strong offer that dies after an attorney-drafted counteroffer adds the wrong kick out clause, and an FHA condo nightmare where a listing claims FHA financing without verifying that the association is actually FHA approved. When the deal cancels, even releasing the earnest money deposit can spiral into months of conflict and attorney involvement. The takeaway is bigger than real estate: access to a platform is not the same as expertise, and convenience often masks a transfer of legal liability from institutions to individuals. If this helped you think more clearly about flat fee listings, DIY real estate, and the true hidden costs of “saving commission,” subscribe, share the episode with a friend, and leave a review so more buyers and sellers can avoid the same traps.
