Arrested for a Facebook Post? Police Power, Bad Orders & Accountability

hat meaA Facebook post about drinking water leads to a felony arrest. The charge gets dropped. Now the police department is facing a state-ordered shutdown. What went wrong, and does “I was following orders” explain any of it? On this episode of Two Cops One Donut, Erik Lavigne breaks down the Trinidad, Texas controversy and debates what officers should understand before putting someone in handcuffs. Knowing the elements of an offense matters. So does having the backbone to question a bad order. Then we turn to Philadelphia, where an officer’s encounter with a man lying in the roadway raises difficult questions about intervention, personal freedom, and responsibility. What should happen when someone needs help but might refuse it? The live chat also gets into qualified immunity, whether the arrest process can become its own punishment, and what meaningful accountability should look like. We close with Boston’s police drone collision and the safety, privacy, and transparency questions that come with new technology. Calling out bad police work. Giving credit where it’s earned. And making room for people who disagree. Cop Shared Her Location? Flock Misuse and Police Accountability

She reported domestic violence. An officer allegedly used police technology to help the relative she accused find her. How do you rebuild trust after something like that? On this episode of Two Cops One Donut, I break down the reported San Jose Flock misuse case and explain why “we fired him” shouldn’t end the conversation. We discuss the difference between firing an officer, revoking police certification, and pursuing criminal charges, along with what meaningful oversight of license plate readers should look like. Then we turn to Pittsburg, California, where police say two searches missed a concealed weapon before a different officer was wounded inside a booking facility. Was this a failure that training could correct, or should it end a career? We finish with a Waymo ride that led to police responding and passengers being arrested. How private is a driverless ride, and what should companies tell you about what they can see? Along the way, the audience challenges me on whether cops need to memorize laws, trespass warnings and ID, and whether people who finish a prison sentence ever really get a fresh start. We call out bad police work, give credit where it’s earned, and leave room for disagreement. Bring your argument. Secret Recordings And Police Accountability

A whistleblower story gets messy fast when the method becomes the headline. We break down the LAPD Daniel Flores case, where an officer reportedly recorded coworkers in a background investigations unit making racist, sexist, and homophobic remarks, then faced criminal charges tied to those recordings. The core question we wrestle with is simple and brutal: if the recordings reveal real misconduct, does that change how we should judge the way the evidence was obtained, especially under California Penal Code 632 and the idea of “confidential communications” in a secure workplace? We talk through the competing realities: hiring and recruitment roles carry massive public impact, but background divisions also exist to protect sensitive applicant data and controlled access spaces. We also dig into the human side of police culture, including how dark humor shows up in trauma-heavy jobs, and how allegations like selective recording or participating in the same offensive talk can damage credibility. Along the way, we ask what most listeners are already thinking: would you trust an internal complaint to succeed without a recording? Then we zoom out to the bigger policing problems people see every day: qualified immunity confusion, uneven accountability, training gaps, and why small rights violations fuel public anger. We also connect it to modern police tech and surveillance, including Flock license plate readers, data retention concerns, and what good policy looks like when an alert pops. Filming Police: Unlawful Arrests, Officer Ego & Accountability

What happens when the people enforcing the law are the ones crossing the line? Sergeant Erik Lavigne joins retired Detective Matt Thornton and retired Atlanta officer Zoel “Red Dog” Murphy for an audience-driven episode of Two Cops One Donut. Together, they review police encounters, challenge questionable decisions, and discuss what meaningful accountability should look like. The conversation covers officers interfering with recording, a driver’s troubling traffic stop, and a lieutenant confronted by another officer over his use of emergency lights. The panel also debates unlawful arrests, excessive force, and the difference between protecting yourself and physically resisting police. Matt shares that his channel was affected by YouTube demonetization, adding a personal perspective to the concerns facing auditors and police-accountability creators. Audience questions take the discussion into phone searches, legally carried firearms, courtroom testimony, and whether police should respond to mental health crises. Expect candid disagreements, firsthand experiences, and plenty of humor as three experienced cops examine their own profession. Can You Be Trespassed From a Public Library? First Amendment Auditors vs. the Law

Can a public library legally trespass you if you haven’t committed a crime? And if the library wants you gone, how far does a responding police officer have to investigate before enforcing that decision? In this episode of Two Cops One Donut, Sgt. Erik Lavigne breaks down a viral interaction involving Long Island Audit and a public library, separating three issues that constantly get mixed together: First Amendment rights, public property, and criminal trespass. The discussion gets into who actually has authority to trespass someone from a government building, whether police need to know why the library wants someone removed, when filming is constitutionally protected, and where officers can cross the line by trying to manufacture charges or solicit an offense. Erik also walks through Texas Penal Code §30.05, Hudson v. State, Wilson v. State, and Kreimer v. Bureau of Police while explaining why “it’s public property” does not automatically mean unrestricted access. The central distinction: a trespass order and the constitutional justification behind that order may be two separate legal fights.  The livestream then expands into a broader conversation about police accountability, officers knowing the elements of an offense, qualified immunity, Pennsylvania v. Mimms, filming police, traffic stops, officer safety, and why cops should be willing to call out bad police work even when it comes from their own side.  Two Cops One Donut is not a police echo chamber. The goal is simple: call out bad policing, highlight good policing, protect constitutional rights, and figure out how the profession can actually improve. Do Cops Get a Pass? Police Accountability and Double Standards

Police officers get arrested, fired, and sent to prison. So why do so many people still believe cops get a pass? In this live episode of Two Cops One Donut, Erik Lavigne examines both sides of the police accountability debate with real cases and questions from the audience. We discuss outcomes that fuel public frustration, cases that resulted in substantial prison sentences, and why punishment alone may not restore trust. Erik also makes his case for doubling sentences for criminally convicted officers. If law enforcement claims a higher standard, what should that mean when an officer violates the public’s trust? The conversation covers qualified immunity, sentencing disparities, courtroom transparency, police database misuse, leadership failures, and protecting officers who report misconduct. The goal is to challenge assumptions, understand legitimate criticism, and ask what fair, consistent accountability should actually look like. Chapters: • 00:00:00 Introduction: Do cops get a pass? • 00:03:23 The upcoming TCOD app and training tools • 00:15:30 Defining accountability: Arrests, convictions, and consequences • 00:22:12 Courtroom transparency and accountability for judges and prosecutors • 00:30:34 Should cops face double the punishment? • 00:39:29 Qualified immunity, settlements, and criminal liability • 00:50:15 Daniel Shaver: An outcome that fuels public distrust • 00:57:56 Laquan McDonald: Examining sentencing disparities • 01:04:12 Walter Scott: What meaningful punishment looks like • 01:16:52 Mississippi’s Goon Squad: Prison sentences and leadership failures • 01:27:34 Patrick Hemingway: Police database misuse and auditing • 01:35:48 Brett Hankison: Conviction, sentencing, and release pending appeal • 01:40:27 What officer arrest data can and cannot tell us • 01:43:35 Better accountability: Transparency, oversight, and whistleblower protection • 01:50:36 Final audience questions and closing thoughts What would meaningful police accountability look like in your community? Cop Goes Head-On: Hero or Reckless?

A cop deliberately goes head-on with a wrong-way driver on the highway. Was he protecting other drivers or taking an unnecessary risk? I called this officer a hero. In this episode, I explain why, address the strongest criticism of his decision, and consider what realistic alternatives he had in that moment. These intentionally shorter Two Cops One Donut episodes are designed to run 8–15 minutes and focus on one incident, one question, or one talking point. Each is a focused conversation you can finish in a short sitting, with a clear argument and room to consider another perspective. They’re an addition to our longer interviews and panel discussions. The goal stays the same: recognize good police work, challenge bad decisions, and bridge the gap between law enforcement and the communities we serve. Listen, decide where you stand, and bring your strongest argument. Arrested for What? When Police Ego Meets Your Rights

A camera, a refusal to answer questions, and an arrest for “criminal loitering.” What justified taking this man’s freedom? Police Sergeant Erik Lavigne breaks down footage from First Amendment Protection Agency and explains why he believes the officers crossed the line. Drawing on nearly 20 years in policing, Erik examines the encounter through the eyes of a responding officer and a supervisor responsible for holding officers accountable. The discussion tackles the right to record, remaining silent, detention versus arrest, and the difference between lawful authority and an officer expecting compliance. Live audience questions push the conversation into qualified immunity, gaps in police training, and what meaningful accountability should look like. Erik also walks through how he would handle the call, including talking with the complainant, explaining protected activity, and recognizing when there’s no enforcement action to take. You don’t have to like First Amendment auditors to care about their rights. Watch or listen, weigh the footage, and decide: what should have happened here?
