Were You Within a Mile of a Crime? The Government Wanted Your Phone Location Data. Judge said NO!

A federal judge just ruled that tower dumps, the police technique of grabbing data on EVERY cell phone near a crime scene, are unconstitutional. Not some tower dumps. All of them. In August 2026, Judge Carlton Reeves (S.D. Mississippi) refused to sign warrants that would have given federal agents the location records of thousands of phones near a series of gang-related shootings in Jackson. He held that a tower dump is a Fourth Amendment search and that every tower-dump warrant is an illegal general warrant, the exact thing the Founders wrote the Fourth Amendment to stop. In this video, I explain how tower dumps work, why police love them, and how Carpenter v. United States, the Fifth Circuit's geofence ruling in United States v. Smith, and the Supreme Court's new decision in Chatrie v. United States led here.  CASE In re Four Applications for Search Warrants Seeking Information Associated With Particular Cellular Towers, No. 3:25-CR-38, 2026 WL 2260371 (S.D. Miss. Police Tased Him and His Pet Snake for “Matching the Description” Because He Had Dreads. OVERTURNED

Police tased Robert Holliday after he "matched the description" from a 911 burglary call. He was walking his two pet snakes around his own apartment complex. A Florida appeals court just reversed his resisting arrest convictions and ordered a judgment of acquittal. Here is why matching a description is not enough for reasonable suspicion under the Fourth Amendment. This video is sponsored by CourtRemind.com. Attorneys, law firms, and bail bond agents: CourtRemind™ connects to your Google or Outlook calendar and automatically texts your clients, plus the family members and cosigners who get them to court, before every court date and office appointment. Fewer missed hearings, fewer warrants, no manual reminders. https://courtremind.com In Holliday v. State (Fla. 5th DCA, Oct. 2, 2026), deputies responding to a 5:00 a.m. 911 call surrounded a man with dreads, a black shirt, and red pants, told him he was not free to leave, and tased him when he walked away. The caller never mentioned the boa constrictor and ball python around his neck. The court held that officers corroborated only innocent identifying details, so the stop was an unlawful Terry stop, and a charge of resisting an officer without violence under Florida Statute 843.02 cannot stand when the officer is not lawfully executing a legal duty. FLOCK CAMERA Searches Violate the 4th Amendment; Federal Judge Throws Out ALL Evidence!

A federal judge just ruled that a cop's FLOCK CAMERA search violated the 4th Amendment and threw out all the evidence. Here is how one California license plate led to a ruling that could change how police use license plate readers across the country. In United States v. Kyle (N.D. Okla., October 1, 2026), a Tulsa County deputy saw an out-of-state plate, ran it through Flock and pulled 30 days of location history: more than 50 sightings across multiple states, with no warrant and no suspicion of any crime. He then stopped the driver for following too closely, questioned her about a short trip to California, and detained her for a K-9 sniff the moment she refused a search. Judge Sara Hill suppressed everything on two separate grounds. First, the deputy unlawfully extended the traffic stop without reasonable suspicion. Second, and far more surprising, the Flock ALPR lookup itself was a warrantless search under the Fourth Amendment. Nearly every court before this one has said license plate readers are not a search. This judge disagreed, relying on Carpenter v. United States and the Supreme Court's 2026 geofence decision in Chatrie v. United States. Is a license plate on a public road fair game, or does a month-long tracking log cross the line? Tell me in the comments. Case: United States v. Kyle, No. 26-CR-00189-SEH, 2026 WL 2958728 (N.D. Okla. Scratched Serial Numbers Enhancement Does NOT Count If Gun Is Traceable. Glock Machine Gun Switch.

A Glock with a machinegun switch had its serial number stamped in three places. Two were scratched off. The Fourth Circuit says that is not enough for a four-level sentencing enhancement, as long as the gun can still be traced. In United States v. Smith (4th Cir. 2026), the court affirmed a machinegun conviction under 18 U.S.C. § 922(o) and rejected a Second Amendment challenge. It then vacated the 57-month sentence, holding that the serial number enhancement under U.S.S.G. § 2K2.1(b)(4)(B)(i) applies only when a firearm is actually untraceable. That puts the Fourth Circuit directly at odds with the Third Circuit, which ruled the opposite way weeks earlier in United States v. Craddock. Can Police Stop You JUST Because You're on Probation or Parole? (California Law)

Can police pull you over in California JUST because the registered owner is on probation or parole — with no traffic violation, no equipment issue, nothing else? In this video, we break down a real 17-minute traffic stop where that was the officer's only stated reason for the stop. We cover the actual California and federal case law behind this: ~Penal Code § 3067(a) — the "Fourth Waiver" every parolee signs ~How probation search conditions differ from parole We also dig into whether a 17-minute stop that ends with no citation, no warning, and no violation found can still be legally justified — and what role the presence of a TV camera crew plays (hint: probably less than you'd think, thanks to Whren v. United States). This is not legal advice — just a breakdown of the law for education and awareness. If you or someone you know has been stopped under similar circumstances, consult a licensed criminal defense attorney. 🔔 Subscribe for more Know Your Rights breakdowns and real-world traffic stop analysis. 👍 Like and comment if you want us to cover more probation/parole search cases. #KnowYourRights #CaliforniaLaw #TrafficStop #ProbationLaw #ParoleLaw #FourthAmendment #Lawstache #PoliceStop #CriminalDefense #CaliforniaProbation Anton Vialtsin, Esq. Cops Wore NIGHT VISION Goggles to Spy on This Driveway... Was It Legal?

Cops used night vision goggles to walk up someone's driveway with NO warrant. Today, we break down People v. Lieng (2010) — a California case that explains one of the most misunderstood concepts in Fourth Amendment law: curtilage. When a sheriff's sergeant walked up a private driveway at 4:30 AM wearing night vision goggles to investigate a marijuana grow, the homeowners argued it was an illegal search. The court disagreed — and the reasoning reveals exactly how much (or how little) of your own property is actually protected from police surveillance. We cover: ✅ What "curtilage" means and why it matters for your 4th Amendment rights ✅ The 4-factor legal test courts use to decide what counts as curtilage vs. "open fields" ✅ Why night vision goggles were ruled legal — and how that's different from the thermal imaging case Kyllo v. United States ✅ Practical takeaways: how to actually protect your property from warrantless surveillance 📌 Case: People v. A man flees a traffic stop, runs into a stranger's house, and hides a gun in an 8-year-old's bedroom — then claims the police violated his 4th Amendment rights. Can he? In this video, we break down United States v.
