Mastering Digital Marketing for Trial Lawyers | Kelly Gordon (SEO + Digital Marketing Specialist)

You can't rank for what doesn't exist. The world of online marketing can seem overwhelming, complicated and exploitive: as lawyers, we know that we're targets for agencies and consultants who see our profession and think $$$. Nevertheless, digital marketing is an area you can't ignore. Fortunately, it's also one where you can hit the ground running and quickly start punching above your weight. But you have to get started. Kelly Gordon is founder & CEO of Dapper Codes, a digital marketing strategy firm. She joins us today to give us direction on how to find your niche as a trial lawyer, the importance of leaning into that niche, having clarity and consistency in your message, what works for SEO in 2026, and how it's all being impacted by AI. Just like with trial lawyers helping those hurt from no fault of their own, the work Kelly and her firm do for small businesses has tremendous, meaningful impact: helping one business owner can impact an entire family.  Make sure the people who need your help know that you're out there. "You can get a lot of people's attention, but if that attention doesn't resonate, then they're not going to buy, and then none of it makes sense. So, 'Who are you? Why do you do what you do? And what is it that you do exactly right?'" - Kelly Gordon In this episode, we discuss: ◼️ The distinction between marketing and visibility. ◼️ Why search engine optimization is just scratching the surface. ◼️ How AI has impacted traditional search results. ◼️ How to make sure that people know you are an option for what they need. ◼️ Why FAQ sections are more important than ever. ◼️ Identifying your unfair advantage and leaning into it. Better Health Equals Better Results | Samuel Johnston (Health + Performance Coach)

Today's episode is part of our effort to put a broader perspective on the work and life of trial lawyers: it's not just about the case, the training and the preparation. It's also about your health, your stamina, work/life balance and your mental strength. Sam Johnston is a fitness coach and former college hockey player, who has become an expert in understanding nutrition, fitness and balance. Sam will be the first to tell you that it is not any one catch-all solution, or latest trend, that will make a difference to your health and stamina. It's finding the right balance, but also doing so in a way that makes sense for your body and performance. Sam shares detailed information on understanding diet, protein, choosing the right fats (and how much is healthy), the impact of alcohol, what are peptides and how revolutionary they are, and so much more.  But at the heart of it is recognition of something that we all need, no matter where we are in life: a coach and mentor. Sam has a coach. His coach has a coach. Sharif and Nael both have mentors who have helped guide them personally and professionally.  When you look after yourself, you have better performance, and better results. And so, you can see why this is so important and relatable to trial lawyers. As in our previous episodes about family balance, team work, avoiding the workaholic syndrome and more, today's focus on health and fitness will help you be better prepared, better focused and better enjoy this work that we are so fortunate to do. " I believe you need to take health into your own hands. You need to have agency over it." - Sam Johnston In this episode, we discuss: ◼️ Why nutrition is foundational for success in the court room. ◼️ How getting regular blood work is so crucial to preventing health issues. ◼️ How to combat the pressure to drink alcohol in social situations, especially for trial lawyers. ◼️ What are peptides and how they can offer various health benefits when used correctly. ◼️ Emphasizing quality over quantity in fitness routines. How to Truly Advocate for Victims of Crime | Renée Williams (Victim Advocate)

If working in Civil Law, and representing victims of crime, is something you do, or aspire to do, it is crucially important to recognize why this work is so important, yet also so specialized. This is delicate work, and understanding the psychology of trauma will determine how you interact with, and represent, your client. Renée Williams is the CEO of the National Center for Victims of Crime, the nation’s leading resource and advocacy organization for victims of all types of crime, and for the people who serve them.  Renée's organization ensures that their member attorneys focus not just on victims, but victims of crime. It's about the technical, legal version of what a crime is. And you have to be a plaintiff's attorney to do this work. Civil Law is the mechanism to hold the powerful to account, because you can't put a church in jail. What people really want is accountability. And yet, it is remarkable how hard the defense continues to fight, even after their client pled guilty. This work can often be a reflection on the values of our society, and what can be a long journey to simply hold someone accountable for their actions. From massage providers to sex assaults and bouncer cases, there sometimes seems to be an endless parade of cases, and law offices & toll-free numbers to cater to them.  Renée's advice: "If you are a victim, you're listening to this and you're considering moving forward, be very picky about your lawyer. Make sure that if they have on their law firm site, "We do sex abuse cases," dig into that. Look and see what cases they've actually done."  You have to be deeply, personally committed to this type of work. Be that lawyer who is passionate about helping victims, and advocating for change. In this episode, we discuss: ◼️ How Civil Law can hold powerful entities accountable when the criminal justice system fails. ◼️ The neurobiology of trauma: why trauma causes victims to have trouble remembering vivid experiences that happened to them.  ◼️ How the trauma of reliving an event can sometimes sadly cause a case to fall apart. ◼️ How to approach a case when the chances of compensation and recovery just aren't there. Your client doesn't want to relive their intense trauma all for just a piece of paper. ◼️ Why victims need to understand the limitations of civil lawsuits. Chapters 00:00 The Impact of Civil Justice on Victims' Rights 11:54 The Role of Civil Law in Accountability and Change 18:04 Organizational and Employer Responsibility 24:16 The Explosion of Bouncer Cases 29:09 Understanding Trauma in Crime Victim Representation 35:52 The Challenges of Pursuing Civil Cases 39:00 The Role of Victims in the Justice System 45:17 Advice for New Lawyers: Integrity and Responsibility Courtroom Stories & Tactics | RVA Trial Lawyers Available on Spotify, Apple, YouTube, and at RVATrialLawyers.com  Based out of Richmond, Virginia, Courtroom Stories & Tactics by RVA Trial Lawyers exists for lawyers who try cases to juries on behalf of people. When Your Client Inspires You to Go Harder | Damon Hudson (Personal Injury Lawyer)

In just one year, Damon Hudson launched his personal injury firm in New Mexico and grew from 20 cases to over 70, a testament not just to results, but to his connection with his clients. There was one case however that stood out, a trip-and-fall case, where the client in question believed so deeply in her case, she had filed a pro se claim herself at state court. The case then got moved to federal court, she met with the defense, and was met with a very low ball offer.  At this point, she knew that she needed good representation. She turned to Damon, and shared the memorable line, "Damon, I'm worried they're gonna make a fool of me." This client was trying so hard, and believed so deeply in her case, it inspired Damon and his firm to go even further to push for a fair, high value settlement. Through multiple rounds of mediation, and multiple temptations to walk away, they persevered with their case until the result they were looking for finally came. Damon shares this inspiring story as part of our conversation on building strong, genuine relationships with your clients, and preserving the integrity of those relationships in the new age of AI. The thing I said to her after was, "Remember where you were when they offered you $750, and remember now when they're offering a lot more than that."  So I was grateful for the trust, that means the world, but you have to earn it.  - Damon Hudson In this episode, we discuss: ◼️ How to navigate a case that starts as pro se. ◼️ Why mediation is one of the best ways to get to know your client. ◼️ Why walking away from a mediation can be a good strategic move. ◼️ The experience of building a PA firm from the ground up. ◼️ Why confidence and curiosity are key traits for successful attorneys. ◼️ The competitive advantage of a firm with genuine, human relationships over AI chat bots and virtual agents.  Chapters 00:00 Taking a Chance on a Pro Se Client 09:03 Navigating Mediation: Strategies and Insights 14:46 Building Trust and Relationships with Clients 18:13 The Human Side of Practicing Law 21:04 Balancing Law Practice Growth with Client Care 37:41 Ethical Use of AI in Legal Practice 43:37 Maintaining Authentic Client Relationships in the Age of AI Courtroom Stories & Tactics | RVA Trial Lawyers Available on Spotify, Apple, YouTube, and at RVATrialLawyers.com  Based out of Richmond, Virginia, Courtroom Stories & Tactics by RVA Trial Lawyers exists for lawyers who try cases to juries on behalf of people. Trial Breakdown: $373,922 Verdict | Gray Broughton Injury Law

How would you approach arguing a personal injury case where there is very little visible damage, there are pre-existing conditions for the client, and a lot of difficulties in gathering evidence?  In fact, would you take such a case in the first place? Our firm Gray Broughton was approached with this challenging car crash case, and despite the long odds, we knew there was an opportunity to get a successful result. But it would take a lot of adaptability and flexibility, drawing from the skills and experience we have accumulated over years of trial wins and losses. Trials are not segmented blocks. Trials are stories. And those stories start in jury selection.  Our conversation today, bringing the Gray Broughton team together to reflect on the process and outcome of this case, ultimately hinges around the importance of jury selection: doing your research and connecting with people on a human level.  Here we had an individual defendant, a sweet young lady, not a corporate defendant. Would the jury recognize that this was not a personal attack, but simply a question of taking an accident and making it right?  "You've got to be intentional about setting the stage, and creating an environment that allows people to be comfortable sharing answers to these otherwise very difficult questions." - Sharif Gray In this episode, we discuss: ◼️ The importance of adapting to jury dynamics in trial cases. ◼️ How you never hear about the less obvious, less headline-grabbing cases, which in reality are the vast majority. ◼️ How to have effective communication with jurors, for better outcomes. ◼️ Why building a strong narrative around the case from the opening statement will influence jury perception. ◼️ The role of a supportive team in navigating trial challenges. ◼️ How the economics are easy, but non-economics are hard. ◼️ The humanization of the client but also the defendant is crucial. Don't Just Assume That It's Nothing | Elliott Buckner (Personal Injury Lawyer)

The defense asks you a seemingly innocuous question, and it's tempting to assume that whatever their angle is, it's probably nothing.  Elliott Buckner learned the hard way that even the most mundane motion can cause major headaches to your case, especially in the hands of a crafty defense lawyer.  If it's not setting off alarm bells, look again. Ask for a second opinion. Ask your friends on the defense bar for their opinion. You can, and should, be collegial with other lawyers, but at the end of the day, we're all here to do the best for our clients. Be prepared. Elliott talks about his experiences with DUI cases, how different insurance coverage can affect your case, and his role as president of the the Virginia Trial Lawyers Association (VTLA) during the pandemic. He reflects on high-profile cases such as the UVA shooting and VCU hazing incident, and the complexities of legal challenges faced in the education sector, particularly in Virginia, where contributory negligence plays a significant role. And we explore the importance of non-economic performers, which can be valued by your clients and juries just as much as the monetary performers. "Is there a better feeling than standing up when the judge says, "Is the plaintiff ready?" "We are, your Honor." And it's your turn to go? I feel an immense privilege and responsibility to be there as the voice for my client. It's a lot of pressure, but that to me is the thrilling aspect of what we do." In this episode, we discuss: ◼️ How collaboration among lawyers enhances the practice of law. You don't need to have your elbows up all the time. ◼️ How homeowners insurance can cover unexpected incidents. ◼️ Why contributory negligence in Virginia can be a barrier, but also has its advantages. ◼️ Why high-low agreements can provide security for clients, and help you gain more trial experience. ◼️ Identifying the value drivers that push your case forward. ◼️ The maxim: "Don't be complacent. Don't make assumptions." Who's Looking Out for You? | Dr. Scott Hickey & Dr. Shawn Borich (Maximum Medical Improvement)

Clients getting hurt for the first time in a significant way often don't know where to go, not just for legal advice but for medical advice.  Not only does it impact their health and their recovery, but it impacts the strength of their case. Without the right medical treatment, without the right supporting doctors and experts, insurance companies just don't take the claims as seriously. Because at the end of the day, they're looking at our clients, and they're not necessarily seeing them as people, but as numbers on a spreadsheet. How can a client find the appropriate medical care that improves their health and their legal case? Dr. Scott Hickey and Dr. Shawn Borich are the physicians behind Maximum Medical Improvement, which helps people find not just a medical specialist, but the right specialist, from the right subspecialty who understands their specific case.  MMI then works with lawyers to help strengthen the legal argument from a medical perspective, by being able to answer specific questions about the specific situation that their client has found themselves in. A resource that advocates for lawyers and patients: MMI is bridging the gap between medical care and legal support. "Patients need an advocate because they don't know the questions to ask. And that's what we can provide, since we know the questions they should be asking" - Dr. Scott Hickey In this episode, we discuss: ◼️ How gaps in treatment can negatively impact both health outcomes and legal cases. ◼️ Why the role of emergency physicians is unique in understanding various specialties. ◼️ Why finding an advocate is essential for patients to receive the care, and legal support, that they need. ◼️ How the healthcare system has shifted towards billing and coding over patient care. ◼️ How to encourage collaboration between medical and legal professionals. Ask For a Bigger Number | Robert Hirschhorn (Jury and Trial Consultant)

How do you set the value for a case? Are you holding your case back from getting what it's really worth? And who makes that determination? Robert Hirschhorn's advice: "Don't put caps on yourself. You want to choose the biggest number that you could ever imagine a jury would award [in a case such as yours], and whatever that number is, multiply it times two." But to be successful, you need to get the jury to sympathize. You need to justify the villainization of the defendant. You need to anchor your case around the numbers, and then move beyond the numbers. Rob's perspective comes from 40+ years as a jury and trial consultant, selecting juries that have returned tens of billions of dollars in verdicts. He speaks from experience when it comes to understanding the difference between a liability jury and damages jury, or knowing what are the right elimination questions.  He also speaks through a lens of personal tragedy, deeper purpose and legacy-building. To that end: be a sponge, never stop learning, and explore new technology, such as Rob's own VerdictHub: a new, AI-driven system that surveys "digital jurors" for incredibly accurate jury predictions. We explore all this and more in this energizing conversation! "When you get to the damages part, you have to mention the amount of money, because if you don't, the amount of money the jury thinks is appropriate will always be lower than what you are going to be asking for." In this episode, we discuss: ◼️ Why it's so important for the jury to know that you care about your client. ◼️ Not limiting yourself with artificial caps on claims. ◼️ Why family members make the best trial partners. ◼️ How to identify and frame the villain in the case. It's not always obvious. ◼️ Dropping low economic damages, and focusing on pain and suffering. ◼️ How Artificial Intelligence is changing the landscape of jury consulting.
