When Legal Hold, Privacy and Retention Hit the Same Data: Building an eDiscovery Program That Holds Up | Data Xposure - Ep 25

The same data can sit under a litigation hold, subject to a privacy request, and on a retention schedule at once, with cross-border restrictions on top. Most eDiscovery programs are built to answer one of those well, and the conflicts only surface when a second request arrives. Host Mike Hamilton talks with Nick Curtis, eDiscovery Manager at Tokio Marine HCC, the Houston-based specialty insurance group. Nick has built and run these programs from both sides, service provider and corporate, and has watched more organizations attempt it than most people in the field. What does it take to stop looking at data through a purely eDiscovery lens and start asking where it lives, who owns it, and which obligations attach to it? How do you design workflows, policies and procedures that hold up when legal, privacy, compliance and security all have a claim? Which decisions have to be made before the technology lands? And how do you get a team self-sufficient enough that the process survives the person who built it? Nick also traces how the program at Tokio Marine HCC matured over time. Legal holds that once took significant manual coordination now go out in minutes, the team has far better visibility into where data actually sits across the enterprise, and a significant share of document review has come back under the legal department's control. Technology made those gains possible, but the drivers were governance decisions, redesigned workflows, and getting legal, IT and compliance aligned on who owns what. For eDiscovery and legal operations managers, information governance and privacy teams, and anyone responsible for data that more than one department has a claim on. Agentic AI and the Changing Data Risk Playbook: XChange 2026 Recap | Data Xposure - Ep 23

Exterro product marketing leaders Fahad Diwan, Bryant Bell, and Robert Bond recap Exterro XChange 2026, Exterro's annual global user conference for eDiscovery, forensics, privacy and compliance professionals, held September 21–23 in Nashville. Across hundreds of customer conversations, one theme kept surfacing: teams are working to connect eDiscovery, privacy, forensics and compliance as investigations and data requests increasingly cross departments. When evidence moves between tools and teams, its integrity has to hold, and how it was collected, analyzed and shared has to be documented. The discussion covers how legal and forensic teams handle litigation, regulatory requests, suspected breaches and employee misconduct: finding relevant evidence, establishing what happened, where AI speeds that up, and what a practitioner still has to review and verify. They also discuss Exterro ARMOUR, Exterro's agentic AI technology for legal, forensic and governance work. Rather than answering questions like a chatbot, it plans and carries out multi-step tasks — pulling in the right data and people, and pausing for human sign-off before anything consequential. The conversation covers where that reduces manual work across investigations and data requests, and where it doesn't. Anonymized customer results include document review in a fraud investigation cut from two weeks to about four hours across 200,000 documents, and document review for an HR data subject request cut from 60-plus hours to about three. Across three early adopter customers, teams report roughly 90% efficiency gains on matters and investigations. For general counsel, legal ops leaders, privacy officers, forensic investigators, and anyone owning data risk across one or more disciplines. Stay Calm, Move Smart: Leading Through Data Risk Without the Knee-Jerk Reaction | Data Xposure - Ep 21

When a legal hold breaks down, a cyber investigation escalates, or a new technology challenges an established workflow, the pressure to act immediately can overwhelm the need to act wisely. For data risk leaders, the difference between a measured response and a reflexive one can determine whether an issue is contained—or compounded. In this episode of Data Xposure, brought to you by Exterro, Thomas Mullane, Associate Director of eDiscovery & Cyber Investigations at RTX, draws on nearly two decades of experience spanning information governance, eDiscovery, privacy, and legal technology. He explores how leaders can maintain perspective under pressure, separate urgency from panic, and make defensible decisions when facts are incomplete and stakeholders are demanding answers. The conversation also examines the tension between innovation and the status quo: when established processes provide necessary discipline, when they become barriers to progress, and how teams can introduce change without creating unnecessary risk. Listeners will leave with a practical framework for staying composed, challenging organizational defaults, and moving forward with clarity rather than reacting out of fear. It reflects Data Xposure’s focus on candid, actionable lessons from practitioners managing real enterprise data risk. Thanks for tuning in to the latest episode of Data Xposure. When Data Preservation Isn't Free: Andy Hansell on Proportionality, Legacy Data, and the AI Arms Race

Preservation law was built for a world of paper, where keeping records meant simply not throwing them away. Data does not work that way, and the gap between those two realities is where cost, risk, and disputes now live. In this episode of Data Xposure, brought to you by Exterro, Andy Hansell, Director Counsel at Target, draws on a career spanning law firm practice, eDiscovery consulting, and in-house leadership. That path gave him fluency in both sides of a discovery dispute: the incentive to drive costs up, and the incentive to keep them down. He explains why preserving legacy systems is far from free, how proportionality applies to preservation and not only to collection and review, and why courts and opposing counsel often assume a database can answer questions it was never built to ask. Andy also offers a contrarian view of AI in litigation. Rather than a defense-side cost saver, he sees an arms race, plaintiffs have more incentive to adopt AI than defendants do, and the result may be more lawsuits, more sharply targeted. Listeners will come away with a practical view of how to defend preservation decisions, communicate data realities to outside counsel, and think clearly about what AI actually changes. From Reactive to Strategic: How Legal Teams Are Rebuilding Around Data and AI | Data Xposure - Ep 18

Legal teams are no longer just responding to litigation, investigations, or compliance demands after the fact. Today, they’re being asked to help organizations proactively manage risk across increasingly complex data environments shaped by AI, regulation, security threats, and rapid business change. In this episode of Data Xposure, we sit down with Linda Luperchio to explore how modern legal and risk leaders are rebuilding their organizations around data and AI. Linda shares her journey from paralegal to executive leadership and reflects on how the profession itself has evolved from siloed legal workflows to cross-functional collaboration spanning compliance, privacy, security, information governance, and business operations. The conversation explores where AI is already creating meaningful value, where organizations still need strong governance and human oversight, and why data has become the foundation for nearly every major risk and business decision. Together, we unpack how forward-thinking organizations are moving from reactive problem-solving to strategic risk management and what leaders must do now to build resilient, data-driven teams prepared for the future.
