Jefferson wrote that governments get their just powers from the consent of the governed. He also wrote that when government becomes destructive of the people’s rights, the people have the right to alter or abolish it. So Scott asks the uncomfortable modern question: What happens when an executive takes sweeping action on immigration, trade, the federal workforce, and military deployment — and keeps going even when courts push back? Jefferson’s answer is about balance. Government exists to protect the natural rights of the citizen. When one branch overwhelms the others, the system starts moving toward despotism.
