BILL OF LADING: How to Build the Record | Foreclosure Wars

Certified Mail can show that an envelope traveled through the mail—but how do you document what was actually inside it? In this episode of Foreclosure Wars, I break down how I use a Bill of Lading, two witnesses, Certified Mail, tracking stickers, postal receipts, postmarks, and retained originals to create a contemporaneous record of outgoing correspondence. I describe the Bill of Lading as a cargo manifest for the documents inside the envelope, rather than simply treating “bill” as meaning an invoice.  mailing.txt We walk through the physical process: two witnesses observe the packet, the Certified Mail tracking information is connected to the Bill of Lading, copies travel with the correspondence, the original remains in the records, and the postal system creates its own tracking and delivery trail. The larger objective is third-party corroboration. Instead of relying solely on the sender’s later testimony about what was mailed, the process is intended to establish multiple independent points in the record: the witnesses, the Bill of Lading, the physical tracking information, the postal receipt, and the delivery record. The episode describes this as establishing “third-party trust” around the correspondence.  mailing.txt We also explore how this fits into the larger Deed of Repentance / Little Short framework and discuss original documents, bills of exchange, agency, public versus private structures, and why I believe physical recordkeeping remains important in an increasingly digital system. Certified Mail tracks the envelope.
The Bill of Lading records the claimed contents.
The witnesses corroborate the process. This episode presents my personal experience, theories, and educational framework and is not legal, financial, or tax advice. The legal or evidentiary effect of these practices depends upon applicable law and the facts of a particular matter.
