SCOTUS Is Critical on the State of Affairs of Cannabis Laws in the U.S.

SCOTUS Is Critical on the State of Affairs of Cannabis Laws in the U.S.

A half-in, half-out cannabis regime cannot stand. But the U.S. Supreme Court recently said it won’t consider a Colorado marijuana dispensary's dispute with the IRS over a deduction restriction for drug-related businesses. The high court rejected the challenge from Standing Akimbo LLC, which operates a state-legal medical marijuana dispensary in Denver. Justice Clarence Thomas vehemently disagreed with the Supreme Court’s refusal to hear this tax case that affects a cannabis dispensary. The conservative justice’s stance strongly suggests he believes any federal marijuana ban is unconstitutional. Tune into this NewsMunchies episode for full commentary on tax, law, and business issues associated with cannabis.

How Cannabis Will Define the 2020 Election

How Cannabis Will Define the 2020 Election

Cannabis legalization is a voting issue. Undoubtedly, the legalization of marijuana will shape the 2020 election. With the economic fallout from the coronavirus crisis and social unrest following the murder of George Floyd by police, cannabis legalization will bring people to the polls this November. Nowadays, my answer to everything is to vote. When you look at a candidate, think about whether he or she supports the modernization of cannabis laws, because that will tell you an awful lot about how they view issues associated with racism, immigration, taxes, banking, and more.

Recent events involving the killing of black men by police have sparked calls for reform in the criminal justice system across the country. My law firm's very own John Mulvihill, a former prosecutor in the State Attorney’s office, talks about the high-profile cases playing out in the media and criminal justice system. Cannabis and racism are two big concepts that are closely connected. African Americans and whites use marijuana at the same frequency, yet you’re four times more likely to go to jail for using marijuana if you’re a person of color. We must reverse the systematic issues that lead to mass incarcerations of African Americans while eliminating police violence.
