EP03: Patents: How Can They Help You? with Joshua Goldberg
Joshua Goldberg joins us in our recent Virtual U.S. Attorney podcast episode. Our guest started as a chemical engineer. After a few years of working with new drug products in designing a tablet or a capsule, he decided to go to law school to become a patent attorney. While in law school, he got a job at the law firm at the time called Nath and Associates as a summer intern. He has been at the firm ever since, and after 25 years, he is now a co-managing partner in the firm. Joshua manages the firm’s Biotech, Pharmaceutical, and Chemical practice. Joshua gives us insights into what kinds of patents are available. In addition, he walks us through the different regions where someone can file for a patent, such as the European Patent Office (EPO). He also gives out some advice regarding how to control and minimize costs. According to him, the two biggest points of value that a patent attorney adds is drafting the patent application to ensure it’s positioned correctly. So not only is it claiming the right thing is your invention, but he drafts it, so it has a lot of fallback options, depending on what the examiner says. And then the second place where the firm can add value is by going back and forth with the examiner to get the right patent.
