Ep 262 — Any Time Now, SCOTUS!

DOCKET ALERTS:   The president is promising to send out $5,000 checks to every American if Republicans win the midterms.   The Fourth Circuit became the ninth appellate court to find that the Trump administration's mandatory detention policy for all immigrants without legal status is patently illegal.   The Trump administration asked the Supreme Court to let it install US Attorneys without Senate confirmation. Time to bring back Alina Habba and Lindsey Halligan!   Andrew and Tristan Tate's motion for bail pending their extradition to the UK was denied by a federal magistrate in Miami.   Hasbro is the latest company to tell the White House to quit using its IP in racist AI slop memes — this time the government is molesting Optimus Prime!   DOOFUS OF THE DAY:    James Piereson has an editorial in the Wall Street Journal wondering if adding new Supreme Court justices is illegal. It's not, and neither is saying absolute drivel in public.   MAIN SHOW:   We're all waiting for SCOTUS to say whether they're planning to let Trump burn down the midterms and refuse to deliver mail-in ballots. In the meanwhile, the US Supreme Court teamed up with the Missouri state Supreme Court to prevent a harebrained scheme by Missouri's Republican Secretary of State, Denny Hoskins, to cram down an even-more-gerrymandered congressional map that would give Republicans an extra seat in the House of Representatives. The Missouri Supreme Court ruled that the new map needs to be approved by the voters before it can take effect, and held Hoskins in contempt for refusing to abide by their September 3 injunction. And the US Supreme Court put the kibosh on a crazy TRO issued by a rogue Trump appointee purporting to require Missouri to use the Trump map. So it looks like Missourians are going to head back to the polls in November under the existing 2022 maps.   Secretary of Commerce Howard Lutnick has a plan to hack the 2030 Census. And that plan is RACISM.   SUBSCRIBER BONUS:   We break down Law & Chaos's DOOFUS OF THE DAY, James Piereson, a non-lawyer who has the legal opinion that expanding the Supreme Court is unconstitutional, even though it definitely isn't.   Lopez Garcia v. How the World Sees the Sad Spectacle of Trumpapalooza

Trumpapalooza has come and gone, and the whole thing was about as insane as we’d expect. The glorified rally has only cemented the lunacy of this second term and shown the world that the US is a shadow of its former self. Ed Luce and Harvard professor Stephen Walt join David Rothkopf to examine the myriad ways that this administration is undermining the US both at home and abroad and why the midterms will be a flashpoint for our country’s future.  Learn more about your ad choices. Can Capitalism Serve the Common Good? - ft. Mariana Mazzucato

The drugs in your medicine cabinet were probably discovered on your dime, in a university lab, with NIH money. You don't hold the patent. You don't set the price. Same story with the touchscreen, the GPS and the voice assistant in your pocket. The public often helps fund breakthroughs, while private companies claim all the profits. Economist Mariana Mazzucato thinks it’s time to renegotiate. In “The Common Good Economy: A New Compass”, she makes the case for reshaping markets around the common good.  Luigi Zingales and Bethany McLean press the uncomfortable question: can a government captured by business really be trusted to change the rules? You can find “The Common Good Economy: A New Compass” here: https://marianamazzucato.com/books/the-common-good-economy/the-common-good-economy-us/  Mariana Mazzucato is a Professor at University College London, Founding Director of the UCL Institute for Innovation and Public Purpose and author of “The Common Good Economy: A New Compass”. The Daily Blast: Trump Tailspins as Latest Plot to Rig Midterms Is Mocked Even on Fox

Donald Trump just tailspinned again in the polls. In a new Quinnipiac survey, his overall approval is at 33 percent and he plummeted to a record low on the economy. Meanwhile, a CNN analysis finds that on the same issue, Trump is an astounding 52 points underwater with independents. That’s the context for Trump’s fake-promise to send $5,000 to every American if the GOP keeps Congress. Many critics dismantled the idea. But even Fox News is gently mocking it: One anchor pointed out that he’s made empty promises of cash before. Bret Baier noted that it would cost $1.3 trillion. And Laura Ingraham pressed Trump: Why not send people the money now? That gets to the heart of this idiotic effort to use federal money to rig the elections. We talked to political scientist Tom Schaller, author of a good piece for the Public Notice Substack on Trump’s inflation disaster. We discuss why the polls look much worse than in 2018, how Trump’s policies created this disaster for the GOP, and why Trump’s magical reality-bending powers might finally be running out.  Looking for More from the DSR Network? Vadym Skibitsky, Ukrainian intelligence: We are fighting for survival

“We don’t have another way for surviving, because we are an independent state, it's our territory, it's our land, it’s our culture, it’s our history, and we must fight to prevent the full occupation by the Russian Federation our territory.” Dan Johnson speaks to Vadym Skibitsky, deputy chief of the GUR, Ukraine’s military intelligence service, about the ongoing war with Russia. Formed shortly after Ukraine declared independence from the Soviet Union in 1991, the GUR is tasked with defending the country at home and abroad through the use of political and military intelligence. Following Russia’s full-scale invasion of Ukraine in February 2022, the service has played a key role in holding off and pushing back Kyiv’s larger neighbour through activities including intelligence gathering, espionage and sabotage. As the war gears up to enter another harsh winter with no obvious end in sight, both sides continue to look for new ways to break the deadlock. In this exclusive, wide-ranging interview, Skibitsky discusses Russia’s use of North Korean troops and military hardware in the war. He also talks about Ukraine's latest strategy of deep-range drone strikes thousands of kilometres into Russia, and how its military plans to grind down Moscow. The Interview brings you conversations with people shaping our world, from all over the world. The best interviews from the BBC, including episodes with journalist Dmitry Muratov, former Sudanese leader Aisha Musa, and Ukrainian drone commander Robert Brovdi. You can listen on the BBC World Service on Mondays, Wednesdays and Fridays at 0800 GMT. Or you can listen to The Interview as a podcast, out three times a week on BBC Sounds or wherever you get your podcasts.
