On Affirmative Action

In this episode, we dive into two of the most contentious policies in U.S. higher education admissions — affirmative action and legacy admissions. While affirmative action seeks to level the playing field for historically marginalized minorities, legacy admissions have long been criticized for entrenching privilege among already-advantaged, predominantly white families. We walk through landmark Supreme Court cases — from Bakke (1978) and Grutter/Gratz (2003) to Fisher (2013/2016)and the recent SFFA v. Harvard & UNC rulings — tracing how the legal landscape has shifted over decades. We close with a thought-provoking question: Does affirmative action fulfill its founding promise of equity, or does it inadvertently build a new elite — simply more diverse, but elite nonetheless?
