    Affirmative Action for Mediocre Men

Leah and Melissa break down what may be a new low for the Court: granting Alabama’s request to reinstate racially discriminatory voting maps. Then, they turn to the big questions: how dead is Trump’s slush fund for insurrectionists? Just how awful are Acting AG Todd Blanche and Acting DNI Bill Pulte? Will Michigan’s Democratic senators stand up to Trump’s appalling nominee for a seat on the U.S. District Court for the Eastern District of Michigan? They also cover three SCOTUS opinions from last week before Melissa speaks with Yale Law Professor Judith Resnik about her recent book, Impermissible Punishments: How Prison Became a Problem for Democracy. Favorite things: Leah: Maria Collett’s speech to the PA Senate on LA v. Callais; Autocratic Judging, Rebecca L. Impregnable Citadel of Technicality

After puzzling over an interesting follow-up question about Pitchford v. Cain, we unpack a summary vacatur in Whitton v. Dixon. We then spend a while breaking down the latest developments in Allen v. Milligan line, in which we discuss the future of the Purcell principle and whether the Court should be unusually attentive to public appearances in election cases. We finish with Sripetch v. Jarkesy, where the Court rejects a requirement that the SEC prove victims suffered pecuniary loss before seeking disgorgement, with specific attention to the interesting Seventh Amendment question raised in Justice Thomas's concurrence. Key Topics[00:03:23] - Listener question on Pitchford v. Cain, AEDPA, and procedural default[00:08:12] - Whitten v. Trump Had A Huge Meltdown On Meet The Press & It Was So Good!

If you haven't watched Trump's latest meltdown on Meet The Press, you should check it out because it's both painful to watch yet so enjoyable to watch this orange man baby crack under tough questioning from Kristen Welker. Trump reported by rehashing his lies about voter fraud, which he used in 2020 when discussing the results of California's election. It's important to remember that Trump is freaking out because his endorsed candidate for governor, Steve Hilton, might not make it into the top two spots in California's jungle primary once all of the votes are counted. This explains the rehashing of the Big Lie about massive voter fraud, especially heading into the 2026 midterm elections. It truly was a massive trainwreck for Trump.  Speaking of the 2026 midterm elections, we discuss whether we're still backing Graham Platner's U.S. Senate candidacy in Maine after a whole week's worth of controversial allegations. And while we're on the topic of trainwrecks, we'll also talk about Bari Weiss and Nick Bilton doing Larry and David Ellison's bidding to kill off all of CBS News' crediibility while turning it into a MAGA propaganda machine. 06-08-26 Part One - California's Flawed Election System

In part one of Red Eye Radio with Gary McNamara and Eric Harley, as California continues to tally election results, state leaders are urging patience as President Trump again complains about the use of mail-in ballots and delays in the results. In the Oval Office on Thursday, Trump accused Democrats of trying to "steal" the California gubernatorial and Los Angeles mayoral primaries without any evidence to support his claim. With many races still undecided, outcomes could take days or even weeks as ballots are counted, including in the governor's race. Also President Trump storms off 'Meet the Press' interview, rips Kristen Welker, ABC, CBS, and CNN as 'crooked' / A look at May's jobs numbers / Gearing up for the World Cup / Audio from Scott Pelley on CBS' bias. The Daily Blast: Angry Trump Storms Out of On-Air Interview For Unnervingly Dark Reason

Over the weekend, Donald Trump exploded during an on-air interview with NBC’s Kristen Welker. He called her “crooked” and “stupid” and abruptly ended the interview in a fury. This was ostensibly because she questioned his claims that California’s ongoing vote counting is rigged against GOP candidates. But we think the real reason is darker. As the votes are being counted, those candidates—Spencer Pratt for Los Angeles Mayor and Steve Hilton for Governor—are looking weaker than advertised. In real time, Trump is witnessing the failure of MAGA’s online disinformation apparatus to invent reality whole cloth and inflate the strength of his candidates into something it isn’t. In today’s episode, tech writer Gil Duran, author of the forthcoming The Nerd Reich, a book about techno-authoritarianism, puts this in perspective. He explains the California contests, why it’s so infuriating for Trump to watch real votes coming in, why this saga represents a larger failure of Trump-MAGA online propaganda, and why that has heartening deeper implications.  Looking for More from the DSR Network?
