Absentee Ballots, Asylum, and Too Many A**holes to Count

Leah, Kate, and Melissa preview this week’s arguments at the Court, including Watson v. Republican National Committee, a challenge over when election offices must receive absentee ballots in order for them to be counted. They also cover a flood of legal news, including the quagmire that is the New Jersey U.S. Attorney’s Office, rulings from lower courts both encouraging (U.S. District Court for the District of Columbia) and grim (the wrong-like-clockwork Fifth Circuit), and the showdown between Senator Rand Paul and Trump’s pick for DHS head, Markwayne “NOSPACES” Mullin. Favorite things: Kate: How to stop a dictator, Zack Beauchamp (Vox); The Case of Kristie Metcalfe (NYT’s The Daily); Project Hail Mary, Andy Weir Leah: The Epic transcript from NJ; luck…or something, Hilary Duff (producer Melody’s pick: Future Tripping; producer Michael’s pick: Adult Size Medium); Her giveaway to celebrate Melissa’s new book (enter here);  Melissa: Love Story Official Playlist (Spotify); Paradise (Hulu); Risk and Resistance: How Feminists Transformed the Law and Science of AIDS, Aziza Ahmed. 03-27-26 Part One - Shut Up, Already!!

In part one of Red Eye Radio with Gary McNamara and Eric Harley, Gary flies solo tonight as Eric attends the Mid America Trucking Show in Louisville, KY. We begin the show with what is decidedly the audio cut of the week. Stephen A. Smith goes off on his fellow Democrats on the Voter I.D. issue by shouting "SHUT UP"!!! (we couldn't have said it better ourselves) Also what authority does President Trump have on Voter I.D., the President issuies emergency funding order for TSA workers, another "No King's" weekend coming up, audio from Barack Obama on skyrocketing electricity prices, audio from AOC blaming President Trump on utility spikes and politically clueless spring breakers encouraged to have fun and enjoy the end of their youth. For more talk on the issues that matter to you, listen on radio stations across America Monday-Friday 12am-5am CT (1am-6am ET and 10pm-3am PT), download the RED EYE RADIO SHOW app, asking your smart speaker, or listening at RedEyeRadioShow.com. Lawfare Daily: How Two Intelligence Community Veterans View the Iran Conflict, with Chip Usher and Aaron Faust

On today's episode, Lawfare Senior Editor Scott R. Anderson sits down with two veterans of the intelligence community to get their take on the ongoing Iran conflict. Before leaving government last year, Aaron Faust was a senior official in the U.S. Department of State's Bureau of Intelligence and Research (INR), where he had previously served as Division Chief for Iran, Iraq, and the Arabian Peninsula. William "Chip" Usher, meanwhile, is the Senior Director for Intelligence at the Special Competitiveness Studies Project and a professor of practice at the Bush School of Government and Public Service at Texas A&M University. He previously spent 32 years with the Central Intelligence Agency (CIA), much of it focused on the Middle East. Together, Scott, Aaron, and Chip discuss the national security threats that Iran presents, the challenges that large-scale military operations against Iran were expected to present, and where the Trump administration—and Iran—may take the conflict from here. For more of Chip's analysis, read his newsletter "Fault Lines" and check out his podcast, "Intel at the Edge.” You can also find Aaron's satirical takes on current affairs on his Substack, Ridiculocracy. Words Matter: Top House Dem: Trump’s Got No Good Options in Iran

Donald Trump’s war in Iran is turning into quicksand. With every decision he makes, we sink deeper into this conflict, and our President is nowhere close to achieving his goals. So what will the next phase of the war look like? Representative Adam Smith, ranking Democrat of the House Armed Services Committee, joins David Rothkopf and Norm Ornstein to share his perspective from Congress on this war and more. The Daily Blast: Trump Explodes in Angry Panic over Midterms as Brutal Fox Poll Hits

Donald Trump is panicking about the midterm elections, leading him to unleash a series of rants on Truth Social. He raged at Republicans for failing to pass voter suppression legislation, urging them to “TERMINATE THE FILIBUSTER” to do so. He followed with a second all-caps tweet reiterating the demand. And he seethed a third time over the GOP failure. Remarkably, Trump doesn’t hide the fact that he sees this as the only way to save the midterms. You can see why: A Fox News poll finds Trump’s disapproval numbers at their highest ever, including a whopping 75 percent of independents, and a large majority opposing the Iran war. We talked to Ryan O’Donnell, executive director of Data for Progress, which has its own polling on all this. We discuss how the war is dovetailing with costs to create a double-whammy, why Trump’s tanking with independents is critical, what could still go wrong for Democrats, and why the high quality of Democratic candidates this cycle is an important tell.  Looking for More from the DSR Network? Mueller Warned Congress. Trump Celebrated His Death.

Trump’s reaction to Robert Mueller’s death was grotesque. But the deeper question is what Congress failed to do when Mueller was alive: why didn’t it impeach Trump based on the Mueller report? Corey Brettschneider and John Fugelsang revisit Mueller’s findings, the Nixon parallel, and the constitutional failure that still shapes Trump’s presidency. Then: a major Supreme Court voting-rights case out of Mississippi, ICE at airports as a new front in Trump’s immigration crackdown, and a federal judge’s ruling against Pentagon restrictions on defense reporters. Plus, a listener from the U.K. asks a question many Americans are asking too: could Trump really defy the Constitution and try for a third term? This week’s episode connects the week’s biggest legal and political stories into one urgent question: how many constitutional guardrails are still holding?
