It’s called a church. Nobody checks whether you’re really one. You say you’re a church, and the federal government takes your word for it. Erika Kirk was Miss Arizona USA in 2012. She is now, by her own framing, a spiritual leader, anointed, called, doing the Lord’s work at the head of an organization that took in $85 million last year. That’s a hell of a career arc, and I want to be fair to her: people find God after a tragedy all the time. What is suspicious, though, is the REAL reason Erika Kirk went full-blown Evangelical, and I’ve got reason to believe it’s all written in the tax code... we found out why. And, there’s another piece of this system that deserves attention. Religious institutions receive significant legal protections around clergy and religious communications, including protections that can make it difficult for the government to force disclosure of certain communications involving clergy. Those protections exist for legitimate reasons, but they also raise an obvious question: what happens when a religious leader implies something harmful, threatening, or otherwise alarming, and the institution can invoke religious confidentiality or privilege to shield the conversation from scrutiny? That is a very different question from whether someone’s faith is sincere. It’s a question about what happens when religious authority, legal protections, and enormous financial advantages all occupy the same space.
