We Need To Talk About Jurisdiction Stripping

In the fourth installment of our Hot Supreme Court Reform September series, Leah sits down with former FTC Chair Lina Khan and Lev Menand, both of Columbia Law School, to talk through ways to limit how much SCOTUS can mess with federal agencies. Lev makes the case for stripping SCOTUS of its jurisdiction over administrative law and sending those cases to a specialized court, and Lina discusses venue and standing issues—reforming who gets to sue and where. Take the Strict Scrutiny survey. New Strict merch available here. • Rational Security: “The Right Kind of American for Rational Security” Edition

    1 วันที่แล้ว

Rational Security: “The Right Kind of American for Rational Security” Edition

This week, Scott sat down with his Lawfare colleagues Executive Editor Natalie Orpett and Public Service Fellow Julia Curlee to talk through the week’s big news in national security, including: "The Xi-Quel." This week, Chinese President Xi Jinping arrives in Washington for a three-day state visit—his first to the U.S. capital in more than a decade, and the second Trump-Xi summit of 2026 after the president’s own trip to Beijing in May. The pageantry will be considerable: Trump plans to greet Xi personally at Joint Base Andrews, followed by a Rose Garden honor guard, a bilateral meeting, and a state dinner. But the substance is heavier than the ceremony. With a 90-day tariff truce set to expire on November 10, China’s rare-earth export controls hanging over global supply chains, a pending $14 billion arms package for Taiwan, and questions about Beijing’s economic lifeline to Iran, the two leaders face a crowded and contentious agenda. What can we actually expect from this summit? Is anyone anticipating a breakthrough—or just a managed continuation of what one analyst called a “managed stalemate”?"A Fjord in the Road." On Friday, President Trump announced that the United States, Denmark, and Greenland had reached an agreement giving Washington what he described as “permanent control over security, and all other needs” in Greenland—capping a year of tension in which Trump had repeatedly threatened to take the Arctic island by economic or even military force. Denmark and Greenland insist the deal respects Greenlandic sovereignty and territorial integrity even as it clears the way for a major expansion of the U.S. military footprint and bars adversaries like Russia and China from establishing bases or making “sensitive investments” there without U.S. approval. Does the deal really give Trump the “permanent control” he is touting? And how did a standoff that once looked like an existential crisis for a NATO ally end up here?"Contempt of Court." World leaders are gathering in New York this week for the annual high-level session of the UN General Assembly. In his speech before the body, President Trump reiterated a number of standard talking points, notably claiming to be a peacemaker even as he again threatened Iran with annihilation. But his administration may be planning something more dramatic: according to the Wall Street Journal and Reuters, the administration has drafted sanctions measures targeting the entire International Criminal Court—not just individual judges and prosecutors, as before—that could aim to cut the Hague-based tribunal off from the global financial system. The implications reach well beyond The Hague, raising hard questions about the weaponization of dollar dominance and the geoeconomic fallout for the banks, contractors, and allied governments that deal with the court. What is Washington trying to accomplish at Turtle Bay—and at what cost?In object lessons, Natalie, following in the footsteps of others before, has found a heartwarming use for AI, relatively speaking. Scott continues to nerd out over treaty law and the museums that love it. And Julia has a slightly less uplifting AI story—but one that could come with merch! The Daily Blast: Fox in Full Meltdown as Network’s Own Poll Hits Trump with Brutal News

Fox News is having profound trouble coping with the spate of terrible stories hitting Donald Trump. Lately the network has been mostly avoiding discussion of the Iran debacle. Fox largely ignored the report of a Russian oligarch funding Don Jr.’s wedding. It didn’t appear to cover Karl Rove’s highly newsworthy warning about racism in the GOP. Meanwhile, a new Fox poll just delivered crushing news to Trump and the GOP: It finds that 63% say Trump made the economy worse; Democrats are substantially leading the GOP on most major issues and in the generic ballot; Democrats are benefiting from a big enthusiasm edge; and much more. Fox often downplays its own polling when it’s bad for Trump, but this time, it seems to be breaking through into the coverage. As Matt Gertz of Media Matters details on this episode, Fox is really in crisis mode amid Trump’s mounting failures and cratering public standing. Gertz takes us inside how Fox deals with bad news for Trump, discusses how Trump-MAGA propaganda functions, and anticipates what’s coming on the right if a big midterm loss badly diminishes him.  Looking for More from the DSR Network? • Roelf Meyer, South African Ambassador: Trump has been misled

Roelf Meyer, South African Ambassador: Trump has been misled

Ione Wells speaks to Roelf Meyer, South Africa’s new ambassador to the United States. In the 1990s, Meyer was one of the leading negotiators in the talks that helped bring apartheid to an end. Now he takes up his new post amid a serious rupture in relations with the US President Trump has cut aid, expelled the previous South African ambassador and offered refugee status to white Afrikaners he says are fleeing persecution, claiming the community faces “genocide”. The South African government rejects that allegation. Meyer, himself an Afrikaner, explains why he believes Trump has been given the wrong picture and how his experience negotiating the end of apartheid could help repair relations with Washington. “The notion of a mass attack on the Afrikaner was misrepresented by those that might have conveyed the message. I mean, I’m an Afrikaner from South Africa myself. And I can say that I’ve never experienced something of that kind. We found it strange. So the source is misrepresented, unfortunately, something that just doesn’t exist,” says Meyer. The Daily Blast: MAGA Radio Host Humiliates Trump by Leaking Truly Brutal GOP Poll Data

Iowa radio host Steve Deace just unleashed an extraordinary social media screed. He confided that GOP pollsters have informed House Republicans that GOP +15 districts are now straight toss-ups, and GOP +10 districts are now “underwater.” He said he regrets this deeply—he badly wants Donald Trump to succeed—but critically, he also declared bluntly that Trump and his Iran war are fully to blame for this fiasco. In a serious humiliation for Trump, he sharply criticized the war’s rationale and warned that this is “risking what’s left of the Trump presidency.” Ouch! This state of play is confirmed by Trump’s own super PAC, which is sinking money into deep red Iowa districts. So we talked to Iowa Democratic Party chair Rita Hart. She discusses whether the landscape is as bad as Deace says, why Trumpy areas are turning on the president, and how to convert this moment into durable gains in rural America.  Looking for More from the DSR Network? • The Workplace Is a Dictatorship? - ft. Elizabeth Anderson

The Workplace Is a Dictatorship? - ft. Elizabeth Anderson

At the center of our market economy sits an institution that runs more like a dictatorship. The firm you work for writes the rules and enforces them. There is no vote, no appeal, and no constitution. The only real remedy is to leave. University of Michigan philosopher Elizabeth Anderson, author of "Private Government" and "Hijacked: How Neoliberalism Turned the Work Ethic Against Workers," argues we spent centuries building limits on rulers who held this much power over people's daily lives, and built almost nothing for the place where most of that life is actually spent.  "Hijacked: How Neoliberalism Turned the Work Ethic Against Workers and How Workers Can Take It Back": https://www.cambridge.org/core/books/hijacked/E7E4A7D850C1E7289BA7AAF910455136 "Private Government: How Employers Rule Our Lives": https://press.princeton.edu/books/hardcover/9780691176512/private-government?srsltid=AU7gw4XkqB24hl23B55i5Stpj4twB-lI8JX8SWqtj09h0AO22q1dBlGl  Connect with us: 📺 Subscribe to our YouTube Channel 📱 Follow Capitalisn’t on Instagram & TikTok ✉️ Email your questions and comments to capitalisntpod@gmail.com  Hosted by Simplecast, an AdsWizz company.
