The DOJ’s Failed Attempts To Meddle In The Midterms

Election Day is upon us, and President Trump is already trying to sow doubt in the results – with the help of the courts. But first, Leah, Kate, and Melissa preview the cases the Supreme Court will be hearing this week, including St. Mary Catholic Parish v. Roy, a Colorado case that puts anti-LGBT discrimination back in the spotlight. Then, it’s time to get into the DOJ’s failed attempt to segregate ballots in California, and its lawsuit against Alaska for allowing more than one candidate named Dan Sullivan to run for Senate. Plus, some fun reenactments of a bonkers hearing on the D.C. golf course Trump wants to renovate. Sports Betting Is This Generation's Big Tobacco

Since the U.S. Supreme Court let states legalize betting on sports in 2018, gambling has exploded. More than half of men ages 18 to 49 say they have an active account with an online sportsbook. Want to bet on a game, a play, or even an individual performance? The bookie is always open on your phone, and it sends promo credits to keep you in the game. Young men see the harm up close. The share of men under 30 who call legal sports betting bad for society has more than doubled since 2022, to 47%. Built to be addictive, sports betting is like cigarettes—and deserves a public health response.  Chapters: 00:01:02 Announcements 00:02:27 Retcon: Healthcare moral hazard vs. cost-sharing; networks and military branches 00:07:37 Terms & Conditions: Handle, the hold, and the tulip bubble 00:12:52 Big Pilcrow: Sports betting, prediction markets, and addiction 00:41:42 Executive Orders: Free museum entry for union members; kid-sized sink staircases 00:44:26 Spiritual Sponsors: Hermanos Gutiérrez; good procedural movies We are entirely listener supported! Ep 276 — Vote Baby Vote!

DOCKET ALERTS:   A magistrate judge in DC dismissed the criminal complaint against Nikki Floris and Bradley Benavides, two decorated FBI agents who wound up on Trump's hit list for being insufficiently supportive of his lies about Chinese interference in the 2020 election.    Associate Attorney General Stanley Woodward entered his appearance in the Broadview 6 case and told Judge April Perry that the government would not be complying with any judicial investigations. Judge Perry was not amused. She set a hearing for November 16, ordered US Attorney Andrew Boutros to show up and testify, and invited anyone with relevant information to appear. That would appear to include Douglas DePodesta, the former FBI supervisor in Chicago who just sued Boutros, AG Todd Blanche, and FBI Director Kash Patel for wrongfully terminating him to make him a scapegoat in this case.   Meanwhile in DC, Stan Woodward is coming perilously close to getting held in contempt in the DC golf course case.   DOOFUS OF THE DAY: Rep. Haley Stevens, for obvious reasons.   ELECTION ROUND UP:   DOJ loses the trollsuit seeking to segregate ballots in Alaska and enjoin certification if Mary Peltola wins, as Chief Judge Sharon Gleason trashes Woodward's lawyering. (Sensing a pattern here!)   Then, we have a comprehensive story about all the ways Donald Trump can't steal the midterms. He's already failed at trying to create a national voter database. He's 0-28 at forcing states to turn over their voter rolls. The ham-fisted efforts by his DOJ to force California to purge alleged noncitizens got dropkicked by a federal district court judge in California, another one in DC, the Ninth Circuit (twice!) and the Supreme Court – all in the span of about 72 hours.   We're gonna make it. And don't forget to VOTE!   US v. Alaska https://www.courtlistener.com/docket/75009254/united-states-v-state-of-alaska/   US v. [25-581] St. Mary Catholic Parish v. Roy

St. Mary Catholic Parish v. Roy Justia · Docket · oyez.org · YouTube Argued on Nov 3, 2026. Petitioner: St. Mary Catholic Parish, Littleton, Colorado.Respondent: Lisa Roy, in Her Official Capacity as Executive Director of the Colorado Department of Early Childhood. Facts of the case (from oyez.org) Colorado voters established the Universal Preschool Program (UPK) to provide free preschool services through a “mixed delivery system” of public and private providers. To receive state funds, providers must sign a nondiscrimination agreement that requires them to enroll students regardless of their sexual orientation or gender identity. Two Catholic parishes and the Archdiocese of Denver sought to participate in the program but refused to sign the agreement. They argued that their religious tenets require them to consider the sexual orientation and gender identity of families during admissions to maintain their religious environment. The schools specifically challenged the program’s “preference system,” which uses an algorithm to match families with schools based on categories like sibling enrollment or congregation membership. They also highlighted a “temporary waiver” provision that allows the state to grant providers extra time to meet certain quality standards. The schools argued that these features create a system of “individualized exemptions” where the state exercises discretion to favor secular interests. Because the state allows these secular preferences while denying a religious exemption to the nondiscrimination rule, the schools contended the program unconstitutionally penalizes them for their religious character. The district court denied the schools’ request for a permanent injunction, ruling that the nondiscrimination requirement is a neutral and generally applicable law. The U.S. Court of Appeals for the Tenth Circuit affirmed that decision, holding that the state’s program does not grant the type of unfettered discretion that would trigger strict scrutiny. Question Does a law lack general applicability under the Free Exercise Clause only if it permits unfettered discretion or secular exemptions, and does the rule against excluding religious institutions from public benefits apply only to explicit government bans on participation?
